Regulations on the appraisal and approval of fire safety design in Vietnam

The content is specified in Circular 06/2022/TT-BCA, which stipulates the process of performing the tasks of fire prevention, fighting, and rescue in the People's Police.

Regulations on appraisal and approval of fire safety designs in Vietnam are as follows:

(1) Regarding dossiers, the receipt and handling of dossiers of appraisal and approval of fire safety designs comply with the provisions of Clauses 4, 6, 7, 8, and 9 of Article 13 of Decree 136/2020/ND-CP.

(2) After receiving the application as prescribed, the officer receiving the dossier shall prepare and record all information in the Control Sheet of the process of handling dossiers on fire prevention, fighting, rescue, and rescue in the People's Police, promulgated together with Circular 06/2022/TT-BCA, and report to the person competent to directly manage, approve, and hand over the dossier to the assigned unit or department for settlement.

(3) Leaders and commanders of units and departments assigned to appraise and approve fire safety designs and assign staff to do so with a control sheet of the process of handling dossiers promulgated together with Circular 06/2022/TT-BCA.

(4) The officer assigned to handle the dossier is responsible for studying and comparing the received dossier according to the provisions of Clause 4, Article 13 of Decree 136/2020/ND-CP with the provisions of laws, regulations, and technical standards on fire safety and taking the following steps:

- Draft content of comments, contents of appraisal, and approval on fire safety;

In case it is necessary to obtain opinions on fire safety from experts, agencies, and organizations for dossiers of application for approval of technical designs or design dossiers of construction drawings containing new and complex technical systems and technologies: Report directly to the leader and commander to propose the person competent to directly manage for consideration and decision;

- In case of proposal for settlement of dossiers: Draft document approving work on a construction site; a written comment on fire safety solutions; a certificate of approval of fire safety designs according to Form No. PC07, Appendix IX issued together with Decree 136/2020/ND-CP; a written approval of fire safety designs according to Form No. PC09, Appendix IX issued together with Decree 136/2020/ND-CP; a written notice of payment of fees for appraisal and approval of fire safety designs (if any); reports and proposals to leaders and commanders directly submitted to competent persons directly managing for approval and signature.

Components of the application for signing are specified at Points a, b, c, d, dd, and g, Section 1, Appendix to the list of components of the dossier to be signed on fire prevention, fighting, and rescue in the People's Police (hereinafter abbreviated as the Appendix to the list of components of the dossier to be submitted for signing) promulgated together with Circular 06/2022/TT-BCA;

- In case of proposal to refuse to handle the dossier: Draft a written response clearly stating the reason, report to the leader or commander directly, and submit it to the person competent to directly manage it for approval and signature. Components of the application for signing are specified at Points a, b, c, e, and g, Section 1, Appendix to the List of Components of the Dossier Submitted for Signing, promulgated together with Circular 06/2022/TT-BCA;

- After the certificate of approval of fire safety design or the written approval of the fire safety design is approved and signed: Making a stamp of approval of the fire safety design according to Form No. PC08 specified at Point d, Clause 11 Article 13 of Decree 136/2020/ND-CP, ensuring the following principles:

Only stamping the approved stamp on the explanation, the drawing shows the approved contents in accordance with the symbol of the drawing as determined in the Certificate of design approval on fire safety or documents approving the design of fire safety;

Filling in all information at the approved mark of fire safety design on the drawing, including the number and date of issue of the certificate of approval of fire safety design or the written approval of the fire safety design;

- Handing over the certificate of fire safety design appraisal and approval or the written approval of the fire safety design together with the dossier stamped "fire safety design approved"
and a written notice of payment of charge for appraisal and approval of fire safety designs (if any) or a written reply enclosed with previously submitted documents and the control sheet for the processing of records for the department returning the results.

(5) Preparing and storing fire safety design appraisal and approval dossiers according to regulations on professional dossiers of the People's Public Security.

For files (files) of copies or copies of dossiers stamped with "Approved and approved fire safety designs" submitted by the investor, units and divisions assigned to appraise and approve fire safety designs are responsible for storing them for exploitation when checking the results of fire safety.
