1. Application of medical examination and assessment for the implementation of the survivor regime in Vietnam

Application of examination and assessment to implement the survivorship regime includes:

- A written request for assessment, made according to the form specified in Appendix 2 to Circular 18/2022/TT-BYT.

- The original or a valid copy of one of the following papers:

+ Summary of medical records;

+ Certificate of disability;

+ Hospital discharge paper;

+ Medical examination book;

+ Medical examination card;

+ Subclinical results sheet;

+ Prescriptions of medical examination and treatment establishments;

+ Records of occupational diseases;

+ Minutes of the most recent medical assessment of the person already examined;

- The original or valid copy of the hospital discharge paper or summary of the medical record specified in Appendix 3 and Appendix 4 issued together with Circular 18/2022/TT-BYT.

In case the employee does not receive in-patient or out-patient treatment, he/she must have papers on injury examination and treatment suitable to the time of the occupational accident and injury to request assessment.

In case the assessee falls into the subjects specified at Point c, Clause 1, Article 47 of the Law on Occupational Safety and Hygiene: The summary of the medical record must clearly state the injury caused by a work-related accident that cannot be treated stably.

2. Order of medical examination and assessment to implement the survivor regime in Vietnam

Step 1: The employee's relatives are responsible for making and completing the examination and assessment dossier and sending it to the Medical Assessment Council (based on Clause 2, Article 11 of Circular 56/2017/TT-BYT).

Step 2: Based on the dossier of the subject to be assessed, the standing body of the Medical Assessment Council is responsible for reviewing and organizing the examination and assessment according to the time prescribed by law. The Medical Assessment Council, within 60 days from the date of receipt of all documents, is responsible for organizing the examination and assessment and issuing the medical assessment minutes.

If after the above time limit no notice has been issued, a written notice must be given and clearly stated the reason (pursuant to Clause 2, Article 11, Circular 01/2023/TT-BYT/pursuant to Point d, Clause 2, Article 39, and Clause 3, Article 166 of Decree 131/2021/ND-CP).

3. Instructions for filling out the application for medical examination and assessment to implement the survivor regime in Vietnam

(1): Enter the number of the social insurance book or the social insurance number. The recording of the social insurance number is only applied when the official social insurance agency gives notice of the use of the social insurance number instead of the social insurance book number.

(2) Note 2: Specify whether or not you are currently working in an environment with the recommended occupational disease risk factor.

In case the employee's relative requests an assessment to receive monthly survivorship allowance, it is not necessary to declare the occupation/job content.

(3) Specify one of the following forms of assessment: first/recurrence/recurrent/summary/review.

(4) Specify one of the following contents: occupational accident/occupational disease/retirement/survival/entitlement to one-time social insurance/maternity benefit.

(5) Specify the name of the injury and illness requested for medical examination and assessment according to the papers on examination and treatment of injury and illness.

(6) Specify the current regime and body damage rate of the most recent medical examination (if any). For occupational accident or occupational disease assessment, specify the bodily injury (if any), including the percentage of such bodily injury that is not enough to enjoy the benefits.

(7) Only apply in cases where the employee's relative is the person responsible for making the application for assessment.
