The People's Police command Inspection Certificates is used according to Form No. 01 issued together with Circular 09/2021/TT-BCA, which is managed, printed, and issued by the Department of Party and Political Affairs at the proposal of the Command, Military, and Martial Arts Department of the Party and Political Work Department.
In particular, the inspection paper of the People's Public Security Command has a term of 5 years.
If the time between receiving the Certificate of Inspection and Investigation and reaching full retirement age under the regime is less than 05 years, the issued People's Police command Inspection Paper is valid until the date of retirement and while waiting for retirement under the regime.
(Article 8 of Circular 09/2021/TT-BCA)
According to Clause 2, Article 9 of Circular 09/2021/TT-BCA, the application for new issuance, renewal, and re-issuance of the People's Police command inspection paper is prescribed as follows:
(i) New application, including:
+ The official letter of request from the staff management unit, enclosed with the employee's horizontal extract, made according to Form No. 05 issued together with Circular 09/2021/TT-BCA;
+ The decision on mobilization or the document assigning the task of inspecting the command of the People's Public Security Forces by the competent authority;
+ 03 (three) photos of size 2cm x 3cm, taken in portrait style with a blue background, wearing autumn-winter clothes, wearing a kepi hat.
(ii) Application for renewal or re-issuance
+ The certificate of inspection of commands must be issued, changed, or reissued when its expiry date has passed, it is lost or damaged, or it is appointed as a leader, commander, or promoted to rank.
Application for renewal or re-issuance shall comply with the provisions of (i). In case the inspection paper is lost or damaged, it must be enclosed with a report stating the reason for the loss or damage, certified by the head of the unit.
The time limit for issuance of Certificate of inspection and investigation of People's Police commands is 10 working days from the date of receipt of complete dossiers of application for new issuance, renewal or re-issuance.
Specifically, in Clause 1, Article 9 of Circular 09/2021/TT-BCA, the competence and subjects of new issuance, renewal and re-issuance of the People's Police Command inspection certificate stipulates as follows:
- Ministry of Public Security leaders in charge of party work and political work must sign, issue, renew, and re-issue the Certificate of Inspection and Regulation of People's Public Security Commands to the Director and Deputy Director of the Party Work Department; and political work in charge of command, military, and martial arts work.
- The Director of the Department of Party and Political Work shall sign the new grant, change, and re-issue of Certificates of Inspection and Investigation of the People's Public Security Forces to leaders and officers of the Party Work Department's Command, Military, and Martial Arts Departments.
- The certificate of inspection of the People's Police Command shall be signed, issued, renewed, and reissued by the head of the police department of the unit or locality to the full-time officer in charge of the inspection and investigation of the People's Police command of the unit or locality.
The People's Police command inspection officer is responsible for performing the tasks specified in Article 4 of Circular 09/2021/TT-BCA, specifically as follows:
- Inspect people's police commands in accordance with the provisions of Circular 09/2021/TT-BCA.
- Implement the Ministry of Public Security's, the Department of Party and Political Work's, and the heads of public security in the units and localities' directions on the inspection and regulation of the people's public security.
- Advise and guide police units, localities, and People's Public Security officers and soldiers to strictly adhere to command, military, and martial arts regulations.
- Propose praising and commending units and individuals for adhering to command, military, and martial arts regulations.
- Remind, correct, or request the prompt handling of units, officers, and soldiers who violate People's Public Security regulations.
- Request that competent authorities take steps to address issues and deficiencies in documents governing the operation of the People's Public Security Forces.
