Application and procedures for issuance of legal aid collaborator's cards in Vietnam are guided in Decision 1017/QD-BTP in 2023 as follows:

1. Application for issuance of a legal aid collaborator's card in Vietnam

A application for issuance of a legal aid collaborator's card in Vietnam includes:

- An application form to be a legal aid collaborator according to the form promulgated together with Circular 08/2017/TT-BTP (Form TP-TGPL-10);

- Proof of being a retired person as prescribed;

- Personal curriculum vitae certified by the People's Committee of the commune, ward, or town where he/she resides, and 02 color portrait photos of size 2 cm x 3 cm.

Note: In the event that it is necessary to use information about the place of residence of the applicant for a legal aid collaborator card, competent agencies, cadres, civil servants, public employees, and individuals assigned to receive and handle administrative procedures and provide public services shall exploit information about citizens' residence in the National Population Database by one of the methods specified in Clause 2, Article 14 of Decree 104/2022/ND-CP.

If it is not possible to exploit a citizen's residence information by the methods mentioned in Clause 2, Article 14 of Decree 104/2022/ND-CP, competent agencies, cadres, civil servants, public employees, and individuals assigned to receive and handle administrative procedures and provide public services may request that citizens submit copies or present one of the valid papers to prove information about residence as prescribed in Clause 3, Article 14 of Decree 104/2022/ND-CP. The types of papers that are valid to prove residence information are specified in Clause 4, Article 14 of Decree 104/2022/ND-CP, including:

- Citizen ID card,

- Identity card,

- Certificate of residence information,

- Notice of personal identification numbers and citizen information in the National Population Database.

2. Procedure for granting legal aid collaborator's card in Vietnam

- A person who meets the criteria specified in Clause 2, Article 24 of the Law on Legal Aid if he/she wishes to be a legal aid collaborator (hereinafter referred to as collaborator) and agrees with the basic contents. of the contract for providing legal aid under the guidance of the Ministry of Justice shall send the dossier to the center in the locality where he/she resides.

- Within 04 working days from the date of receiving the dossier, based on the legal aid needs of the people and actual conditions in the locality, the Director of the Center selects a dossier and submits it to the Director of the Department of Justice for consideration and the grant of a collaborator's card. In the event that the dossier is not valid, it shall be returned to the person who proposes to be a collaborator and clearly notified in writing of the reason.

- Within 03 working days from the date of receiving the valid dossier submitted by the Center's Director, the Director of the Department of Justice considers and decides to grant the collaborator's card. In the event of a refusal, the reason must be clearly explained in writing to the applicant to be a collaborator. The person denied the membership card has the right to appeal against the refusal to grant it. The settlement of complaints shall comply with the provisions of the law on complaints.

- Within 30 days from the date of issuance of the card, the legal aid collaborator is responsible for coming to the Center to sign a contract to provide legal aid. Unless there is a legitimate reason, it can be extended, but not more than 35 days from the date of issuance of the card.

3. How to apply for a legal aid collaborator's card?

- Submit application directly at the headquarters of the State Legal Aid Center of the province/city;

- Send documents via postal service;

- Send documents by fax, electronic form.

* Note: The submission of the application to be a collaborator is done as follows:

- In case of direct submission at the Center's headquarters, the applicant to be a collaborator shall submit the following documents: Application form to be a collaborator; Personal curriculum vitae certified by the People's Committee of the commune, ward, or township where he/she resides and 02 color portrait photos of size 2 cm x 3 cm; present the original or submit a certified true copy of the document proving that the person is retired as prescribed;

- In case of sending dossiers via postal service, the requester to be a collaborator shall send the following documents: Application form to be a collaborator; Personal curriculum vitae certified by the People's Committee of the commune, ward, or town where he/she resides, and 02 color portrait photos of size 2 cm x 3 cm, certified copies of papers proving that the person is retired according to the law;

- In case of sending via fax or electronic form, the applicant to be a collaborator shall send the following documents: Application form to be a collaborator; proof of being a retired person as prescribed; Personal curriculum vitae certified by the People's Committee of the commune, ward, or town where you reside and 02 color portrait photos of size 2 cm x 3 cm to the Center.
