Regarding this issue, LawNet would like to answer as follows:

The Ministry of National Defense issued Circular 86/2023/TT-BQP amending and supplementing a number of articles of Circular 170/2021/TT-BQP dated December 23, 2021 of the Minister of National Defense on training, testing, and issuance of military driving licenses; Fostering knowledge of road traffic laws for drivers of specialized motorbikes in the Ministry of National Defense.

1. Amendments to regulations on revocation of military driving licenses in Vietnam

According to Clause 2, Article 1 of Circular 86/2023/TT-BQP amending Article 46 of Circular 170/2021/TT-BQP, the revocation of military driving licenses is as follows:

- The vehicle and motor vehicle agency, the focal unit under the Ministry of National Defense, has the authority to request the revocation of military driving licenses when detecting acts of fraud or falsification of records and papers to obtain, renew or re-issue a military driving license.

- The vehicle and motor vehicle agency, the focal unit under the Ministry of National Defense, sends an official dispatch with the military driving license requesting revocation to the Vehicle and Machinery Department/General Department of Engineering.

- Within 07 working days from the date of receiving the official dispatch requesting revocation, the Department of Vehicles - Machinery/General Department of Engineering shall consider and decide to revoke the military driving license according to regulations.

2. Revocation of the Certificate of training in legal knowledge about road traffic in Vietnam

Circular 86/2023/TT-BQP also amends and supplements Article 53 of Circular 170/2021/TT-BQP on revoking certificates of training in legal knowledge on road traffic.

Accordingly, the motor vehicle agency, the focal unit under the Ministry of National Defense, has the authority to request revocation of the Certificate of training in legal knowledge on road traffic for drivers of specialized motorbikes in the Ministry of National Defense when detecting acts of fraud or falsification of records and papers to obtain, renew, or re-issue a Certificate.

The Motor Vehicle Agency, the focal unit under the Ministry of National Defense, sends an official dispatch with the Certificate of training in legal knowledge on road traffic for drivers of specialized motorbikes in the Ministry of National Defense, requesting its recall to the Department of Vehicles and Machinery/General Department of Engineering

Within 07 working days from the date of receiving the official letter requesting revocation, the Department of Vehicles and Machinery/General Department of Engineering shall consider and decide to revoke the Certificate of training in legal knowledge on road traffic for drivers of specialized motorbikes in the Ministry of National Defense according to regulations.

3. Order and procedures for issuing new military driving licenses in Vietnam

According to Article 43 of Circular 86/2023/TT-BQP regulating the order and procedures for issuing new military driving licenses, as follows:

- Director of the Department of Vehicles and Machinery/General Department of Engineering decides to issue military driving licenses to candidates who pass the test.

- The application for a military driving license shall comply with the provisions of Article 9 of Circular 170/2021/TT-BQP and supplement the following documents:

+ Decision to establish the Council;

+ Decide to establish a Secretariat and Testing Team and recognize candidates eligible to take the test;

+ Minutes of meetings of the Council;

+ The list of candidates who meet the requirements of the test has been approved by the Director of the Department of Vehicles and Machinery/General Department of Engineering;

+ Written request from the management agency to issue or change military driving licenses (attached to the list of requests for military driving licenses).

- The order of execution:

+ Within 05 working days from the end of the test, the military driver training facility shall prepare 01 set of documents according to the above regulations and send them to the Department of Vehicles - Machinery/General Department of Engineering;

+ Within 10 working days from the date of receiving complete documents as prescribed, the Department of Vehicles - Machinery/General Department of Engineering is responsible for evaluating and fully supplementing the documents; Approve the list; and issuing military driving licenses to candidates who pass the test according to regulations.
