Regarding this issue, LawNet would like to answer as follows:
According to Article 25 of Circular 32/2023/TT-BCA, at the end of the patrol and control period, the Traffic Police Team must perform the following tasks:
- The Team Leader must meet the Team to learn from experience, comment, evaluate the advantages and shortcomings, propose ideas, and record them in the planning book and diary of road patrol and traffic control about the situation of order, traffic safety, results of patrols, control, handling of administrative violations, other related issues, proposals, recommendations, and signatures.
- Report on the situation and results of the Team.
- Hand over to the unit's management staff:
+ Records of administrative violations, related documents, exhibits, seized vehicles, on-the-spot fines, documents, images collected by professional technical means, equipment, or other means;
+ Means of transport, vehicles, professional technical equipment, weapons, support tools and other equipment.
The handover must be recorded in a book according to regulations, signed by the deliverer and recipient, clearly stating their full names, and the head of the unit must be responsible for the handover.
Thus, at the end of the work, the traffic police team must perform the above work, including handing over fines on the spot to the unit's management staff.
Pursuant to Article 23 of Circular 32/2023/TT-BCA, traffic police must handle traffic incidents as follows:
- Resolve and handle traffic accidents
The Traffic Police Team is in charge of patrolling and controlling, directly detecting or receiving information about traffic accidents, or being assigned by unit leaders to the scene of traffic accidents, must urgently deploy forces to the scene and perform the duties of Traffic Police officers according to the regulations of the Ministry of Public Security on assignment of responsibilities and coordination of relationships in the investigation and resolution of traffic accidents.
- Solve traffic congestion
+ In case the traffic jam is not serious and has a narrow scope, the Head of the Traffic Police Team assigns specific tasks to each Team member to guide, regulate, and command traffic to relieve the jam. In cases of necessity, coordinate with the road management agency and local authorities to resolve;
+ In case of serious traffic congestion, affecting traffic activities on a large scale, the Head of the Traffic Police Group preliminary determines the cause of congestion and assigns Team Members to guide, regulate, and command traffic to reduce the level of congestion;
Notify and coordinate with relevant agencies, units, and localities to organize remote traffic diversion and regulation;
Timely report to unit leaders and local authorities to mobilize and strengthen coordination forces to resolve the problem.
- Solve road problems
+ Place sign number 245a "Go slowly" or sign number 245b (for foreign routes); Arrange officers to guide traffic regulation;
+ Notify road management, operation, and maintenance units to deploy forces to implement remedial and repair measures to ensure smooth and safe traffic;
+ Notify and coordinate with relevant agencies, units, and localities to organize traffic diversion and regulation remotely.
- Resolve vehicle fire and explosion incidents on the road.
+ Place sign number 245a "Go slowly" or sign number 245b (for foreign routes);
+ Report fires, incidents, and traffic accidents with people trapped in vehicles on the road to the Fire Prevention, Fighting, and Rescue Police force in the area where the fire occurred at phone number 114;
+ Organize rescue and emergency escape for people sitting in the vehicle; Organize first aid for victims (if any);
+ Use firefighting, rescue, and rescue vehicles and equipment on patrol and control vehicles; Mobilize firefighting, rescue, and recovery equipment and means of vehicles circulating on the road or of neighboring individuals and organizations according to regulations for firefighting, rescue, and recovery;
+ Participate in performing tasks as requested by firefighting and rescue commanders;
+ Regulate and divide traffic flow to avoid traffic jams.
