Advisory bodies in Vietnam to submit to the Minister of Transport draft legislative documents 

According to Circular 26/2022/TT-BGTVT, draft legislative documents must be approved by assigned advisory bodies for submission to the Minister.

The advisory bodies to submit to the Minister a draft legislative document includes the departments: the Construction Investment Management Department, the Vietnam Expressway Department, and the Information Technology Center (hereinafter referred to as the advisory body) are assigned according to the following provisions:

(1) Legal Department: draft laws, ordinances, and other legislative documents assigned by the leadership of the Ministry;

(2) Department of Planning and Investment: legislative documents on strategy, sector development planning, investment planning, statistics, import, and export; economic - technical norms on statistics, strategies, and planning in the transport sector; on investment attraction and investment in the form of public-private partnerships in the stage of investment policy;

(3) Department of Organization and Personnel: legislative documents on functions, tasks, powers, and organizational structure of the Ministry and organizations under the Ministry; training and fostering civil servants and human resources; labor, wages, and regimes and policies for employees; emulation and commendation work in the transport sector;

(4) Department of Transportation: legislative documents on transport, transport support services, cooperatives, security, and traffic safety in the transport industry; economic - technical norms on transportation; transport support services; on training, coaching, testing, granting, recognizing, and revoking licenses, driver's licenses, and professional certificates for vehicle drivers, vehicle operators, and specialized equipment in transportation ;

(5) Department of Traffic Infrastructure: legislative documents stipulating the management, maintenance, protection, and exploitation of transport infrastructure nationwide; economic - technical norms on management and maintenance of traffic infrastructure according to competence; on natural disaster prevention and control and search and rescue under the responsibility of the Ministry of Transport;

(6) Department of Science, Technology, and Environment: legislative documents on scientific, technological, and environmental activities, quality measurement standards, intellectual property, technical management, quality of products and goods in the field of transportation; economic - technical norms except for economic - technical norms specified at points (2), (4), (5), (12), and (13);

(7) Department of Finance: legislative documents on finance, property, taxes, fees, charges, and service prices for road use;

(8) Department of International Cooperation: legislative documents in the field of international cooperation in the transport sector;

(9) Department of Business Administration: legislative documents on enterprises related to the transportation industry;

(10) Ministry Inspector: legislative documents on inspection, complaint, denunciation, anti-corruption, and internal audit in the transport sector;

(11) Office of the Ministry: legislative documents on control of administrative procedures, records, and archives;

(12) Construction Investment Management Department: relevant legislative documents on investment and construction management during the formulation of investment projects (except for projects funded by ODA or foreign concessional loans) and project implementation phase; cost estimates for specific construction works in the transport sector (except for norms of new technologies, new materials, and maintenance norms);

(13) Vietnam Expressway Authority: normative documents on investment, construction, resource mobilization, and operation of the expressway system; economic - technical norms on expressways when assigned by the Minister;

(14) Information Technology Center: legislative documents related to the field of information technology in the transportation industry.

In addition to the above provisions, the advisory agencies are responsible for advising and submitting to the Minister other draft legislative documents when assigned by the Minister.
