The President has issued Decision 1161/2021/QD-CTN dated June 30, 2021 on pardon in 2021. There are 15 cases that are not eligible for pardon in Vietnam.

Specifically, Article 4 of this Decision stipulates that people who are eligible to request pardon according to regulations may not request pardon in Vietnam if they fall into one of the following cases:
(1) Sentenced to prison for treason to the Fatherland; crime of activities aimed at overthrowing the people's government; espionage crime; Crime of violating territorial security; riot; terrorism aimed at opposing the people's government; Crime of sabotaging physical and technical facilities of the Socialist Republic of Vietnam; Crime of making, storing, disseminating, or propagating information, documents, and items aimed at opposing the State of the Socialist Republic of Vietnam; Crime of disturbing security; Crime of sabotaging detention facilities; terrorism or one of the crimes specified in the Chapter on crimes undermining peace, crimes against humanity and war crimes of the Penal Code.
(2) The judgment, part of the judgment, or decision of the Court against that person is being protested according to cassation or retrial procedures in the direction of aggravating criminal liability.
(3) Being prosecuted for criminal liability for other crimes.
(4) Previously granted pardon.
(5) Having 02 or more criminal records.
(6) The remaining term of imprisonment is over six years for people specified in Clauses 1 and 2, Article 3; over eight years for people specified in Clauses 3 and 4, Article 3 of this Decision.
(7) Sentenced to prison for a very serious or particularly serious crime that violates national security, except for the case specified in Clause 1, Article 4.
(8) Committing organized murder; murder of a hooligan nature; intentionally causing injury in an organized or hooligan manner or committing multiple crimes against one person or once against many people or using dangerous acids or dangerous chemicals; rape of an incestuous nature; incestuous rape of a child (according to the 1999 Penal Code) or incestuous rape of a person under 16 years of age or incestuous rape of a person under 10 years of age; robbery with the use of weapons; Robbery, robbery, organized theft of property, or causing serious, very serious, especially serious consequences; against a person performing official duties in an organized manner or committing a crime 2 times or more, causing serious consequences, or inciting, enticing, or inciting others to commit a crime; robbing property multiple times, robbing property multiple times, stealing property multiple times (two or more times).
(9) Committing a drug crime, robbery, or kidnapping for the purpose of appropriating property with a remaining term of imprisonment of more than 01 year for a person sentenced to imprisonment of less than 07 years, or the remaining term of imprisonment is more than 02 years for people sentenced to imprisonment from 07 years to 15 years, or the remaining term of imprisonment is more than 03 years for people sentenced to imprisonment of more than 15 years or life imprisonment.
(10) Committing one of the crimes specified in the Chapter on crimes against human life, health, dignity, and honor of the Penal Code intentionally with a remaining prison term of more than 02 years for those sentenced to imprisonment from 10 to 15 years or the remaining term of imprisonment is over 03 years; for those sentenced to imprisonment over 15 years, life imprisonment.
(11) Instigators, leaders, and commanders in organized crime cases; people who use cunning tricks and stubbornly oppose organized crime cases; professional criminals.
(12) There are grounds to confirm the illegal use of narcotics.
(13) Sentenced to imprisonment for committing three or more crimes or committing two or more intentional crimes, including cases of combined punishment.
(14) Having a criminal record and being sentenced to imprisonment for an intentional crime.
(15) Having been sentenced to imprisonment, including cases where criminal records have been erased or have been sent to a compulsory education facility, including previous educational institutions, or having been sent to a reformatory and sentenced to imprisonment for one of the following crimes: Drugs; killing; child rape (according to the 1999 Penal Code) or rape of a person under 16 years old; robbery; property robbery; confiscation of property; fraudulent appropriation of assets; theft of property; kidnapping to appropriate property; resisting people performing public duties; trafficking in women (according to the 1985 Penal Code) or human trafficking; trading, exchanging or appropriating children (according to the 1999 Penal Code) or trading in people under 16 years old or exchanging people under 01 year old or appropriating people under 16 years old; disturbing public order; Consuming property obtained by someone else's crime; lending at high interest rates (according to the 1999 Penal Code) or lending at high interest rates in civil transactions; Organizing or brokering for others to leave, enter or stay in Vietnam illegally.
