1. 11 contents of specialized religious inspection in Vietnam

Specifically, according to Article 3 of Circular 04/2016/TT-BNV, the Government Committee for Religious Affairs and the Department of Home Affairs Inspectorate have the authority to inspect the implementation of the law on the following contents:

- Registration of religious activities, registration of religious activities, recognition of religious organizations.

- Establishment, division, separation, merger, and consolidation of affiliated religious organizations.

- Registration of associations, religious orders, monasteries, and other collective spiritual organizations.

- Establishing, managing, and dissolving training schools, opening training courses for people specializing in religious activities.

- Ordination, ordination, appointment, election, election, dismissal, and dismissal of religious dignitaries.

- Moving the place of activities of dignitaries and monks.

- Register for the annual religious activity program of the grassroots religious organization.

- Annual meetings and congresses of religious organizations and affiliated religious organizations.

- Publishing activities of publications, religious publications.

- Inspecting the observance of the law on the responsibilities of state administrative agencies in the performance of religious activities.

2. Tasks and powers of a specialized religious inspector in Vietnam

Pursuant to Article 4 of Circular 04/2016/TT-BNV, the tasks and powers of specialized religious inspectors in Vietnam include:

- Government religious committee

+ Develop a plan for specialized inspection of religion and send it to the Inspector of the Ministry of Home Affairs, submit it to the Minister of Home Affairs for approval, and organize the implementation of the inspection plan when it is approved;

+ Inspect the observance of specialized laws on belief and religion;

+ Inspect cases with signs of law violation when assigned by the Minister of Home Affairs or Chief Inspector of the Ministry of Home Affairs;

+ Monitor, urge, and examine the implementation of conclusions, recommendations, and handling decisions about their inspection;

+ Summarize and report to the Inspectorate of the Ministry of Home Affairs on the results of the specialized inspection;

+ Inspect other cases assigned by the Minister in accordance with law;

- Head of the Government Committee for Religious Affairs

+ Lead, direct, and inspect the work of specialized religious inspection;

+ Decide on inspection according to the inspection plan approved by the Minister of Home Affairs;

+ Decide on an unexpected inspection when detecting signs of violations of the law on belief or religion or at the request of the Minister of Home Affairs or Chief Inspector of the Ministry of Home Affairs; assign civil servants to perform the task of specialized religious inspection;

+ Propose to competent state agencies to amend, supplement, and promulgate regulations to suit management requirements; to propose the suspension or cancellation of illegal regulations discovered through inspection;

+ Request the Chief Inspector of the Ministry of Home Affairs to handle the overlap in inspection scope, subjects, contents, and time within the scope of state management of the Government Committee for Religion and summon civil servants and public employees to participate in the inspection team specialized in religion;

- Legal Department - Inspector, Government Committee for Religious Affairs

The Department of Legal Affairs - Inspection, the Government Committee for Religion, is the advisory body for specialized religious inspection with the following duties and powers:

+ Assume the prime responsibility for and coordinate with relevant units under the Government Committee for Religion in formulating inspection programs and plans, reporting them to the Head of the Committee, and sending them to the Inspector of the Ministry of Home Affairs for submission to the Minister of Home Affairs for approval;

+ Carry out inspections according to plan, regular inspections, and unexpected inspections when assigned by the Head of the Government Committee for Religious Affairs;

+ Receive citizens; receive and process complaints, denunciations, petitions, and reflections from citizens in the field of religion;

+ Monitor, urge, and examine the implementation of conclusions, recommendations, and handling decisions on inspection in the religious domain;

+ Handle according to their competence or propose competent state agencies to handle violations of the law on religion discovered through inspection;

+ Preside over or participate in scientific research; organize conferences and seminars on specialized religious inspection;

+ Synthesize, develop reports on inspection results, and settle complaints and denunciations; organize preliminary and final reviews of the performance of specialized religious inspection tasks;

+ Examine, verify, conclude, and recommend to the Head of the Government Committee on Religion to settle complaints and denunciations related to religion in accordance with law;

+ Advise the Head of the Government Committee on Religion to submit to competent agencies for promulgation, amend and supplement documents on settlement of complaints and denunciations in the field of religion;

+ Perform other tasks assigned by the Minister of Home Affairs, the Head of the Government Committee for Religious Affairs or as prescribed by law.

- Department of Internal Affairs

+ Carry out inspection and examination; settle complaints and denunciations in the field of religion in accordance with law;

+ Perform other duties and exercise other powers as prescribed by law.

- Director of the Department of Internal Affairs

+ Perform the duties and responsibilities of the Director of the Department as prescribed in Article 7 of Decree 24/2014/ND-CP;

+ Review and approve the annual plan for specialized religious inspection;

+ Decide to conduct a specialized inspection of religion according to the approved plan and set up an inspection team;

+ Perform other duties and exercise other powers as prescribed by law.

- Inspector of the Department of Internal Affairs

The Department of Home Affairs Inspectorate is an organization under the Department of Home Affairs that has the following tasks and powers:

+ Perform duties and powers according to Article 27 of the Law on Inspection 2022 and Article 6 of Decree 90/2012/ND-CP;

+ Advise and assist the Director of the Department of Home Affairs to conduct specialized inspections and settle complaints and denunciations related to religion in accordance with the law;

+ Perform other duties and exercise other powers as prescribed by law.
