Regarding this issue, LawNet would like to answer as follows:

1. Forms of publicizing content in the detention work of the people's police in Vietnam

Specifically, in Article 5 of Circular 81/2019/TT-BCA, based on the characteristics, nature, and contents that must be disclosed, detention facilities apply one, some, or all of the following forms:

- In writing, notices were posted at places of citizen reception, such as visiting houses, interrogation rooms, and common living places within the detention facility.

- Via the detention facility's radio system.

- Directly notify persons held in custody or temporary detention.

- Other suitable forms.

2. Contents that must be publicized regarding the detention work of the people's police in Vietnam

According to Article 4 of Circular 81/2019/TT-BCA, the contents that must be disclosed regarding the detention work of the people's police include:

(1) Rights and obligations of persons held in custody or temporary detention; regulations of detention facilities; list of objects prohibited from being brought into custody or temporary detention rooms.

(2) The observance of the internal regulations of the detention facility, the health of the detainees, and the detainees according to the provisions of law.

(3) Food, clothing, accommodation, living, and medical care regimes and standards for persons held in custody or temporary detention; the regime of spiritual activities for persons held in custody or temporary detention; the regime of care and nurture for children under 36 months of age living with their mothers in detention facilities.

(4) Regulations on meeting relatives of persons held in custody or temporary detention; cases where persons held in custody or temporary detention are not allowed to meet relatives, defense counsels, or consular contacts.

(5) Regulations on handling for persons held in custody and temporary detention: receiving gifts; the destruction of objects on the list of prohibited items from being brought into custody or temporary detention rooms; sending and receiving letters, books, newspapers, and documents of persons held in custody or temporary detention in accordance with law.

(6) Forms of disciplining persons held in custody or temporary detention who commit illegal acts or violate the internal regulations of detention facilities; commending persons held in custody or temporary detention for their achievements.

(7) Competent authorities and places to settle complaints, denunciations, and lawful requests about the rights of agencies, organizations, individuals, and persons held in custody or temporary detention. Results of inspection, examination, and settlement of complaints, denunciations, and requests of persons held in custody or temporary detention in accordance with law.

(8) Location and schedule of receiving citizens, relatives of persons held in custody or temporary detention; regulations on reception places for citizens and relatives of persons held in custody or temporary detention; suggestion box; hotline phone number.

3. Responsibilities of relevant agencies, organizations, and individuals in making publicity in Vietnam

Agencies, organizations, and individuals involved in publicizing the contents of temporary detention have the following responsibilities:

- To strictly abide by the provisions of law in the management of persons held in custody and temporary detention at detention facilities.

- To present documents as prescribed by law when visiting and contacting persons held in custody or temporary detention and requesting settlement of related affairs; strictly abide by the rules and instructions of officers and soldiers performing their duties at the detention facility.

- To detect and denounce illegal acts in the management and education of persons held in custody and temporary detention; participate in the struggle and prevent violations of the internal regulations of detention facilities.
