Regarding this issue, LawNet would like to answer as follows:
According to Article 3 of Decree 56/2011/ND-CP (amended in Decree 05/2023/ND-CP), the job-based preferential allowances for public servants and health public employees are as follows:
(1) Allowance rate of 70%
The 70% allowance applies to regular public employees and employees who directly perform the following jobs:
- Testing, examining, treating, and taking care of patients with HIV/AIDS, leprosy, tuberculosis, and mental illness;
- Forensic examination, forensic psychiatry, pathology.
(2) Allowance rate of 60%
The 60% allowance applies to regular public servants and employees who directly perform the following jobs:
- Examining, treating, and taking care of emergency patients, emergency resuscitation, emergency 115, infectious diseases;
- Testing and prevention of infectious diseases;
- Border medical quarantine.
(3) Allowance rate of 50%
The 50% allowance applies to civil servants and public employees who regularly examine, treat, care for, and serve patients with anesthesia, resuscitation, intensive care, pediatrics, anti-toxicity, burns, and dermatology.
(4) Allowance rate of 40%
The 40% allowance applies to regular civil servants and public employees who directly work in preventive medicine; testing, medical examination and treatment; infection control, patient care, functional rehabilitation; medical assessment; traditional medicine; cosmeceuticals; food safety and hygiene, medical equipment; reproductive health at public health service establishments and at nursing facilities for war invalids, sick soldiers, and people with special disabilities,
Except for cases entitled to 50%, 60%, 70% allowances.
(5) Allowance rate of 30%
The 30% allowance applies to the following civil servants and public employees:
- Civil servants and public employees who regularly and directly work as medical professionals to perform the following tasks: health communication and education; population - family planning;
- Public servants and public employees who manage and serve but are not directly working as medical professionals at establishments, institutes, specialized hospitals, and centers: HIV/AIDS, leprosy, tuberculosis, psychiatry, pathology, and forensics.
(6) Allowance rate decided by the head of the unit
For civil servants and public employees who do not directly work as medical professionals; public servants and health workers in charge of management and service at medical non-business units in general (except for the subjects specified at Point b, Clause 5, Article 3 of Decree 56/2011/ND-CP); public employees doing medical professional work at agencies, units, or schools shall:
Heads of units, based on job characteristics and revenue sources to consider and decide, but do not exceed 20% of the current salary level or rank plus allowances for leadership positions, allowances for seniority in excess of the bracket. (if any) of the beneficiary.
(7) Allowance rate of 100%
Job-based preferential allowances for preventive healthcare and grassroots health workers apply from January 1, 2022 to the end of December 31, 2023:
- The allowance rate of 100% applies to public employees who regularly and directly work in preventive medicine (including border medical quarantine); do medical professionals at health stations of communes, wards and townships, regional polyclinics, maternity wards, medical centers of districts, urban districts, towns, provincial cities, and cities affiliated to central-affiliated cities and hospitals of districts, urban districts, towns, provincial cities, and cities affiliated to central-affiliated cities.
- During the period of application of job-based preferential allowance for preventive medicine and grassroots health workers specified in Clause 7 of this Article, Point c, Clause 2 of Article 3 of Decree 56/2011/ND-CP and regulations for public employees who regularly and directly work in preventive medicine specified in Clause 4, Article 3 of Decree 56/2011/ND-CP
Periods not counted for preferential allowances according to the medical profession in Vietnam
Periods not counted for the preferential allowances according to the medical profession in Vietnam include:
- The period of working, or studying abroad is entitled to 40% of salary as prescribed in Clause 4, Article 8 of Decree 204/2004/ND-CP;
- The duration of studying in the country continuously for more than 3 months without directly working as a medical professional according to the assigned tasks for civil servants and public employees;
- The period of unpaid leave from work continuously for 1 month or more;
- Time off from work to enjoy social insurance in accordance with the law on social insurance;
- The period of temporary detention, custody, temporary suspension from work, or suspension from medical practice is 1 month or more.
- The period of being dispatched by a competent agency to work or work in a non-medical profession continuously is 1 month or more.
