The investment phases in the construction project of worker housing in industrial parks in Vietnam according to Article 57 Decree 100/2024/ND-CP are as follows:
- Investment preparation phase:
+ Proposals; Decision, approval of investment policy; planning of worker accommodation are implemented synchronously with the infrastructure investment project of the ndustrial park according to laws on the management of ndustrial parks and economic zones, investment laws, and other related laws;
+ The selection of the investor for the worker accommodation project in the ndustrial park is carried out according to housing laws. In case an enterprise that operates ndustrial park infrastructure directly invests in worker accommodation, the ndustrial park infrastructure enterprise is the investor of the worker accommodation project. If an enterprise, cooperative, or union of cooperatives operating in the ndustrial park leases land or sub-leases land to invest in the construction of worker accommodation in the ndustrial park, then the enterprise, cooperative, or union of cooperatives operating in the ndustrial park is the investor of the worker accommodation project;
+ Land allocation, land leasing, and land usage change are carried out according to land laws;
+ Procedures for the establishment, appraisal, and approval of the project are carried out according to construction laws.
- The project implementation phase includes surveying, establishing, appraising, and approving construction designs, issuing construction permits, constructing, operating construction projects, and inspecting the completion of construction projects according to construction laws.
- The project completion phase includes handing over, finalizing construction contracts, and other related procedures carried out according to construction laws, housing laws, and other related laws.
According to Article 59 Decree 100/2024/ND-CP, worker housing in industrial parks in Vietnam must ensure environmental safety according to the following regulations:
(1) The environmental safety distance of the accommodation must comply with environmental laws and construction laws to ensure the safety of the construction and be determined synchronously when evaluating the environmental impact of the ndustrial park.
(2) There must be separate paths and gates from the industrial production zone, with the distance of the gates and separate paths ensuring fire safety according to laws.
(3) There must be a separate isolation fence for the worker accommodation area and the industrial production zone.
(4) A green belt with a width of ≥ 10 m must be set up around the worker accommodation area.
(5) The environmental safety distance from pollution sources in the ndustrial park, such as production workshops, warehouses for materials, finished products, waste with toxic properties, and other ancillary constructions generating non-domestic waste, must be ensured.
The management and use of worker housing in industrial parks in Vietnam are according to Article 61 Decree 100/2024/ND-CP as follows:
- The investor organizes the management and operation of worker accommodation by themselves or hires and commissions a competent unit to perform the management and operation of the worker accommodation.
- Worker accommodation must be leased to the correct target audience.
- Unauthorized changes in the purpose of use are not allowed.
- The maintenance of the construction must comply with construction laws.
- The management unit of the worker accommodation must establish rules for the use of the accommodation, publicly announce them for workers renting the accommodation and related units and individuals to know and implement.
- The management unit of worker accommodation is allowed to run other lawful businesses within the worker accommodation area to reduce the operational management service cost.
- The management and operation of worker accommodation are entitled to the same preferential mechanisms as public utility services.
