Regarding this issue, LawNet would like to answer as follows:

1. Who is the Environmental police?

Environmental police is a branch of the police specialized in preventing, detecting, fighting against criminal and administrative offenses related to environment; proactively and cooperatively preventing, fighting against crimes and violations of law related to natural resources and food safety related to environment.

(Article 3 of the Ordinance on Environmental police forces 2014)

2. 04 prohibited acts of officers and soldiers of the Environmental police forces in Vietnam

Prohibited acts of officers and soldiers of the Environmental police forces in Vietnam include:

(1) Disclosure of secrets, information, and documents of cases under investigation and verification without public permission to irresponsible persons in any way.

In the event of receiving a request to provide information and documents from the mass media and other relevant agencies about the contents of the case because they are assigned the task of investigating and verifying, this must be reported and approved by the competent authority.

(2) Taking advantage of the name of work to go to agencies, organizations, or meet privately to cause difficulties, troubles, or receive gifts in any form.

(3) Arbitrarily contacting the subject under investigation and people related to the cases under investigation. In the event that the object is found on its own, it must be immediately notified to the unit leader for handling.

Only learning and verifying information sources, applications, and letters of denunciation of crimes and violations of the law on environment, natural resources, and food safety by agencies, organizations, and individuals when assigned by leaders.

(4) Taking advantage of assigned tasks and powers to infringe upon the interests of the state and the lawful rights and interests of agencies, organizations, and individuals.

(Article 9 of Circular 83/2019/TT-BCA)

3. Responsibilities of the Environmental police forces in Vietnam

According to Article 8 of Circular 83/2019/TT-BCA, the responsibilities of the Environmental police forces as follows:

- The Environmental police forces are responsible for coordinating with competent agencies in inspecting the observance of the law on environment, natural resources, and food safety by agencies, organizations, and individuals; requesting agencies, organizations, and individuals to give explanations for acts showing signs of crime or administrative violations on environment, natural resources, and food safety, providing information and documents; and objecting to clarify violations of the law on environment, natural resources, and food safety.

- Environmental police forces are responsible for coordinating with forces, using vehicles, and applying police work measures according to the provisions of the law and the Ministry of Public Security to prevent and fight against crime and violations of the law on environment, natural resources, and food safety;

Detecting causes and conditions for crime and violations of the law on environment, natural resources, and food safety to propose competent State agencies to take preventive and remedial measures.

- Officers and soldiers of the Environmental police forces, when performing their duties at agencies and organizations, must strictly comply with the provisions of the law and the Ministry of Public Security and take responsibility before the head of the unit for the work they have carried out.

- Officers and soldiers of the Environmental police forces, when working with agencies, organizations, and individuals, must have a work plan and carefully prepare work contents; anticipate unexpected situations; and plan to deal with those situations. The content of the work plan must be approved by the unit leader.
