Vietnam: Additional cases of tonnage reduction of ships and boats in the near future

From October 12, 2021, many cases are entitled to a reduction in tonnage of ships and boats until the end of 2023 according to Circular 74/2021/TT-BTC amending and supplementing Circular 261/2016/TT-BTC< /a> regulations on maritime fees and charges and the schedule of maritime fees and charges.

Specifically:

**For ships transporting oil in Van Phong Bay - Khanh Hoa, the following rates apply :

1. From October 12, 2021 to the end of December 31, 2021

Equal to 50% of the toll rate specified in Clause 1, Article 7 of Circular 261 of Vietnam

2. From January 1, 2022 to the end of December 31, 2023

Equal to 80% of the toll rate specified in Clause 1, Article 7 of Circular 261/2016 of Vietnam

3. From 01/01/2024 onwards

Equal to the fee rate specified in Clause 1, Article 7 of Circular 261/2016 of Vietnam

** For ships carrying containers for export, import, transshipment into and out of ports on Cai Mep - Thi Vai river with a total tonnage of 50,000 GT or more, the following rates shall apply :

Equal to 60% of the toll rate specified in Clause 1, Article 7 of Circular 261/2016

2. From January 1, 2022 to the end of December 31, 2023

 

- Vessels with a gross tonnage of between 50,000 GT and less than 80,000 GT

Equal to the fee rate specified in Clause 1, Article 7 of Circular 261/2016

- Vessels with a gross tonnage of 80,000 GT or more

Equal to 80% of the toll rate specified in Clause 1, Article 7 of Circular 261/2016

3. From 01/01/2024 onwards

Equal to the fee rate specified in Clause 1, Article 7 of Circular 261/2016

The tonnage of ships and boats is specified in Clause 1, Article 7 of Circular 261/2016/TT-BTC of Vietnam for ships entering and leaving maritime areas, specialized ports, and offshore oil and gas ports; Foreign ships operating in Vietnamese waters that are not part of seaport waters are as follows:

Therefore, according to the new regulations of Vietnam, starting from October 12, 2021, there will be many cases of the free tonnage of ships and boats until the end of 2023.

In addition, the tonnage of ships and boats is free of charge in the following cases:

- Vessels entering and leaving the maritime area to:

(i) Avoid storms, avoid bad weather that does not ensure safety for ships, give first aid to patients without loading and unloading goods, without picking up or dropping off passengers;

(ii) Transfer of people, property, ships rescued at sea not associated with commercial activities as certified by the port authority;

(iii) Participating in search and rescue, flood and storm prevention and control, and protection of sovereignty over seas and islands according to dispatch orders or approval of competent state agencies.

- Vessels of foreign armed forces come to the maritime area to transport weapons, equipment, supplies, spare parts for procurement or aid for the people's armed forces; official or courtesy visit at the invitation of the State of Vietnam; ships carrying foreign youth to the maritime area for cultural and sports exchanges at the invitation of ministerial-level agencies or ministerial-level agencies of the Vietnamese Government.

- The boat or canoe of the mother ship carrying passengers anchored in the water area, the water area carrying passengers in and out of the port.

- Lash barge operates in the maritime area with Lash ships.

- Boats in transit to Cambodia.

- Vessels exiting Cambodia to Cambodia through Vinh Xuong - Thuong Phuoc border gate have been cleared by the inland waterway port authority for ships at the wharf or inland waterway port and have collected the applicable fees and charges at the wharf or port. inland waterways according to the provisions of Circular 248/2016/TT-BTC of Vietnam.

- Vessels sailing to a quarantine or isolation position in another maritime area (where the quarantine conditions are met by the competent authority) are dispatched by the maritime port authority to serve the prevention and control work, control and quarantine during the epidemic announcement by competent state agencies (this is new content and will be applied from August 27, 2021).
