Minimum wage as a basis for social insurance premiums in Hanoi, Vietnam

Hanoi Social Security issued Dispatch 2588/BHXH-QLT on the minimum wage serving as a basis for social insurance, health insurance, unemployment insurance, occupational accident and occupational disease insurance premiums in Vietnam from July 1, 2022.

Specifically, Official Disptach 2588/BHXH-QLT stipulates the minimum wage in Hanoi, Vietnam as follows:

- Region I: 4,680,000 VND/month;

(According to Decree 38/2022/ND-CP, Region I in Hanoi includes Gia Lam, Dong Anh, Soc Son, Thanh Tri, Thuong Tin, Hoai Duc, Thach That, Quoc Oai. , Thanh Oai, Me Linh, Chuong My and Son Tay town)

- Region II: VND 4,160,000/month;

(According to Decree 38/2022/ND-CP, Region II in Hanoi includes the remaining districts of Hanoi, including Ba Vi, Dan Phuong, Phu Xuyen, Phuc Tho, Ung Hoa and My Duc)

- Region III: 3,640,000 VND/month;

- Region IV: 3,250,000 VND/month;

- Minimum wage is the lowest salary paid to employees who do the simplest jobs in normal working conditions in order to ensure a minimum standard of living for workers and their families, in accordance with working conditions and social economic development.

- The employer operating in an area in any region shall apply the prescribed minimum wage rate for that area;

 If the unit or branch operates in different areas with different minimum wages, in which area the unit or branch operates, the minimum wage rate prescribed for that area shall apply;

Units operating in industrial parks or export processing zones in different minimum wage zones must apply in the areas with the highest minimum wage.

In addition, the responsibilities of the employer are specified as follows:

- Review the agreements in the labor contract, the collective labor agreement, and the employer's regulations to adjust and supplement accordingly;

It is not allowed to remove or reduce the salary regimes when employees work overtime, night shift, compensation in kind and other regimes in accordance with the labor law.

- The contents agreed upon and committed to in the contract, labor agreement or other lawful agreements that are more beneficial to employees than those specified in Decree 38/2022/ND-CP, will be carried out.

In which, the salary regime paid to employees who perform jobs or titles through vocational training or vocational training is at least 7% higher than the minimum salary, the implementation will continue, unless the two parties agree on other agreements in accordance with the labor law.

- Adjust the salary paid for social insurance, health insurance, unemployment insurance, occupational accident and occupational disease insurance according to regulations before July 25, 2022.

(The above minimum salary is the basis for paying social insurance premiums for employees.)

Past the above time limit, for cases where the unit has not yet requested to adjust the salary according to the regional minimum wage:

The social insurance agency will temporarily adjust the salary paid for social insurance, health insurance, unemployment insurance, and occupational accident and occupational disease insurance by the new regional minimum wage for employees doing the simplest jobs until the unit prepares an adjustment dossier according to the law.
