The Ministry of Finance has just issued Circular 127/2021/TT-BTC amending regulations on fees for the right to provide pay TV services.

Accordingly, from January 1, 2022 to the end of December 31 , 2022, pay TV service providers pay quarterly fees. As follows:

- If the revenue from charging the right to provide pay TV services is VND 50 billion or less (excluding value-added tax), the fee will continue to be free.

- If the total revenue is more than VND 50 billion (excluding value-added tax), such arising rate will be calculated at 0.3% of the revenue from charging the right to provide pay TV services (calculated at the rate of 0.3%). calendar year contract).

That is, from the quarter where the total accumulated revenue from January 1 of the calendar year is more than VND 50 billion, the enterprise shall calculate and pay a fee for the part of the total revenue that is more than VND 50 billion.

Example 1:

In 2022, enterprise A has a revenue of pay TV services of VND 40 billion in the first quarter and VND 20 billion in the second quarter, then:

- In the first quarter, enterprise A does not have to pay fees.

- In the second quarter, enterprise A must pay the following fees: (40 + 20 - 50) billion VND x 0.3% = 30 million VND.

- From the third quarter onwards, when revenue from pay TV services is generated, enterprise A must pay a fee = 0.3% x Quarterly revenue.

Example 2:

In 2022, enterprise B has a revenue of pay TV services in the first quarter of 60 billion VND:

- Enterprise B must pay the fee for the first quarter as follows: (60 - 50) billion VND x 0.3% = 30 million VND.

- From the second quarter onwards, when revenue from pay TV services is generated, enterprise B must pay a fee = 0.3% x Quarterly revenue.

Example 3:

In 2022, enterprise C has a pay TV service revenue of less than or equal to VND 50 billion, enterprise C does not have to pay fees in 2022.

In addition, Circular 127/2021/TT-BTC also stipulates that: From January 1 , 2023 , enterprises shall calculate and pay fees for the total revenue generated in the quarter (0.3% x total revenue). quarterly revenue). The time to pay the fee is the 20th day of the first month of the next quarter.

Previously, according to the old regulations, from January 1, 2022 onwards, the revenue from charging the right to provide pay TV services is the total revenue arising from contracts with pay TV subscribers in the past year. charge period (excluding value added tax) (according to Clause 1, Article 1 of Circular 94/2020/TT-BTC ).
