June 6, 2023, the Ministry of Finance of Vietnam promulgated Circular 36/2023/TT-BTC stipulating the collection rate, mode of collection, payment, management, and use of fees for certification of origin (C/O) (effective July 21, 2023) as follows:

Fees for Certificate of Origin (C/O) from July 21, 2023 in Vietnam

The fee for certification of origin (C/O) is regulated as follows:

- In case of issuance of certificates of origin: 60,000 VND/set of C/O.

- In case of re-issuance of certificates of origin: 30,000 VND/set of C/O.

Fee payers and fee-collecting organizations for certificates of origin in Vietnam

- The person paying the C/O fee is a trader who applies for a certificate of origin and submits a dossier requesting a competent agency or organization to issue a certificate of origin.

- C/O fee-collecting organization is an agency or organization competent to issue certificates of origin in accordance with the law on foreign trade management, including: the Ministry of Industry and Trade and other organizations authorized by the Ministry of Industry and Trade to issue certificates of origin of goods.

Declaration and payment of fees for certification of origin in Vietnam

- Charge payers shall pay fees according to the above-mentioned fee rates to the fee-collecting organizations when submitting dossiers for issuance of certificates of origin; Fees are paid in the form specified in Circular 74/2022/TT-BTC stipulating the form and time limit for collection, payment, and declaration of charges and fees under the jurisdiction of the Ministry of Finance.

- No later than the 5th of every month, the fee-collecting organization shall pay the entire amount of fees collected in the previous month, the interest arising on the balance of the specialized fee collection account opened at a credit institution (if any) to the fee account awaiting payment to the budget of the Ministry of Industry and Trade opened at the State Treasury.

- The Ministry of Industry and Trade declares, pays, finalizes fees, and pays arising interests (in the fee account awaiting payment to the State budget opened at the State Treasury) according to the provisions of Circular 74/2022/TT-BTC; management and use of fees according to the following regulations:

The fee-collecting organization is responsible for:

++ Paying 100% of the fee collected to the state budget (central budget). The source of expenses for service provision and fee collection is guaranteed by the state budget (central budget).

++ Annually, make a budget estimate for service provision and fee collection (including funding for authorization to issue certificates of origin) according to the regime and norms of state budget expenditure as prescribed by law.

+ In case the fee-collecting organization is eligible for a set of operating expenses from the toll collection as prescribed in Clause 1, Article 4 of Decree 120/2016/ND-CP detailing and guiding the implementation of a number of articles of the Law on Fees and Charges, 83% of the collected fee shall be used to cover the cost of service provision and fee collection as prescribed in Article 5 of Decree 120/2016/ND-CP and pay expenses to organizations authorized to issue certificates of origin and collect fees in accordance with law; pay 17% of the collected fee amount into the state budget (central budget) according to chapters and subsections of the State Budget Index.
