What are conditions for conducting HIV screening tests in Vietnam?

On October 28, 2024, the Government of Vietnam issued Decree 141/2024/ND-CP providing guidance on the Law on Prevention and Control of Human Immunodeficiency Virus causing Acquired Immunodeficiency Syndrome (HIV/AIDS).

What are conditions for conducting HIV screening tests in Vietnam?

- HIV Screening Tests Provided by Medical Facilities:

In addition to meeting the general conditions for a testing facility as stipulated in Clause 8, Article 40 of Decree 96/2023/ND-CP, or complying with the provisions of Decree 103/2016/ND-CP, the following additional conditions must be met:

+ Personnel: Laboratory staff must have a professional qualification of college level or higher in one of the majors such as medicine, pharmacy, biology, or chemistry, and hold a certificate of completion of training in HIV testing techniques;

+ Have appropriate testing equipment and storage for biological products and specimen samples relevant to the specific HIV testing techniques carried out by the facility;

+ Infrastructure: Must have a fixed location.

- HIV Screening Tests in the Community:

+ The individual conducting the test must have a certificate of completion of training in HIV counseling and testing;

+ Must have testing tools and appropriate biological product storage compatible with the type of HIV test biological products used;

+ The testing location must be flat, clean, and adequately lit.

Decree 141/2024/ND-CP comes into effect on December 15, 2024.

The following documents will cease to be in effect from the date Decree 141/2024/ND-CP comes into effect:

- Decree 108/2007/ND-CP providing detailed implementation of certain provisions of the Law on HIV/AIDS prevention and control;

- Decree 75/2016/ND-CP stipulating the conditions for conducting HIV tests;

- Decree 90/2016/ND-CP on the treatment of addiction to opiate substances using substitution therapy.

- Repeal of Clauses 1 and 2, Article 16, Chapter VIII, in the field of HIV/AIDS prevention as per Decree 155/2018/ND-CP which amends certain regulations related to investment conditions under management of the Ministry of Health.

- Repeal of Point b, Clause 1, Point b, Clause 2, and Point b, Clause 3, Article 13 of Decree 63/2021/ND-CP.
