On July 31, 2024, the Minister of Labor, War Invalids, and Social Affairs of Vietnam issued Circular 07/2024/TT-BLDTBXH concerning the Management Board in public service providers in the sector of labor, people with meritorious services, and social affairs in Vietnam .
The dismissal of members of the Management Board, including the Chairman, in public service providers operating in the sector of labor, services for people with meritorious contributions, and social affairs, shall be conducted under the following circumstances:
- A written request from an individual voluntarily resigning from the Management Board;
- Being restricted in legal capacity or not having sufficient health to undertake the assigned tasks;
- More than 50% of the total members of the Management Board submitting a written request for dismissal;
- Being convicted by a Court with a legally effective judgment;
- Being disciplined with a warning or reprimand, leading to diminished credibility and inability to carry out the assigned tasks; being reprimanded twice during the same appointment period or rated at the level of not completing tasks for two consecutive years;
- Being concluded by a competent authority to have degraded in political ideology, ethics, lifestyle, “self-evolution”, “self-transformation”, violated the prohibited actions for Party members, failed to uphold exemplary responsibilities, adversely affecting the reputation of the individual and the unit of employment;
- Being concluded by a competent authority to have violated political standards according to the regulations on internal political protection of the Communist Party and the State to the extent that dismissal is necessary;
- Having other violations as stipulated in the Organizational and Operational Regulation of the public service provider and the Operational Regulation of the Management Board;
- Retirement, resignation, job transfer, or being reassigned by a competent authority to a position incompatible with the structure of the Management Board as stipulated in Article 9 of Circular 07/2024/TT-BLDTBXH.
