Vietnam: Types of ships to be imported for breaking from December 30, 2019

On November 12, 2019, the Government of Vietnam issued Decree No. 82/2019/NĐ-CP prescribing the import and breaking of used ships.

In comparison with current regulations, Decree No. 82/2019/NĐ-CP of Vietnam’s Government has annulled 05 types of used ships eligible for import for dismantlement (floating rigs, jack-up rigs, ship-type floating storage units, floating storage and offloading facilities, other ships) and remained used nonmetallic hull ships which are allowed to be imported for breaking, including:

- Ships carrying dry cargo, including general cargo, bulk cargo, equipment, wood chips, timber, grains, packaged merchandise, and iron and steel products.

- Container ships.

- Ore carriers.

- Ships carrying liquid cargo, including crude oil, oil products and vegetable oil.

- Ships carrying gases or liquefied gases.

- Ro-Ro ships, passenger ships, sea barges and ferries.

This Decree requires that enterprises that import of used ships and/or carry out ship-breaking operations shall purchase and fulfill obligations under environmental damage insurance policies for the import and breaking of used ships in accordance with law regulations.
