Vietnam: To step up the work of appellate appeals of administrative cases in Vietnam

On August 6, 2021, the Procurator General of the Supreme People's Procuracy of Vietnam issued Directive 07/CT-VKSTC on continuing to strengthen the work of appellate protest, cassation and reopening of administrative cases and civil cases.

According to Vietnam's Directive 07/CT-VKSTC, it is necessary to focus on performing well a number of key tasks related to appellate protest, such as:

The district-level People's Procuracy, the provincial-level People's Procuracy, and the senior-level People's Procuracy of Vietnam have strengthened the work of appellate protest in order to reduce the percentage of court judgments and decisions being canceled by their superiors without any protest from the Procuracy.

Improving the quantity and quality of appellate appeals; especially peer-to-peer appeals.

When detecting that the first-instance judgment or decision which has not yet taken legal effect violates the law, if there is not enough time left for appellate protest, it shall notify the violation judgment or decision immediately to superior procuracies to consider and protest according to its competence;

At the same time, it is necessary to immediately overcome the fact that the lower procuracies send copies of the first-instance judgments, decisions, procuracies, and notices of appeal (if any) too late to the superior procuracies. This directly leads to the situation that when detecting violations of judgments or decisions, there is no time limit for protesting.
