Vietnam to increase permissible age limits of non-commissioned officers and commissioned officers of People’s Public Security Forces

On June 22, 2023, the National Assembly of Vietnam approved the Law on People’s Public Security Force (amended) 2023, which contains regulations on the increase of permissible age limits of non-commissioned officers and commissioned officers of People’s Public Security Forces.

According to the Law, regulations on permissible age limits of non-commissioned officers and commissioned officers of People’s Public Security Forces are as follows:

(i) Non-commissioned officers: 47 (increased by 2 compared to the previous regulation)

(ii) Company-grade officers: 55 (increased by 2 compared to the previous regulation)

(iii) Major and Lieutenant-Colonels: Male: 57; Female: 55 (increased by 2 compared to the previous regulation for both males and females)

(iv) Senior Lieutenant Colonels: Male: 60; Female: 58 (increased by 2 for males and 3 for females compared to the previous regulation)

(v) Colonels: Male: 62; Female: 60 (increased by 2 for males and 5 for females compared to the previous regulation)

(vi) General-grade officers: Male: 62, Female: 60 (previously, the permissible age limit for both males and females was 60)

Regulations on permissible age limits of male commissioned officers prescribed in (v) and (vi) and female commissioned officers prescribed in (iv) and (v) shall be implemented according to the roadmap to retirement age for workers according to the Labor Code.

Maximum number of Major Generals of People’s Public Security Forces to be increased to 162 persons

According to Point b Clause 3 Article 1 of the Law on People’s Public Security Force (amended) 2023, the maximum number of Major Generals of People’s Public Security Forces shall be increased to 162 (previously, it was 157). The number includes:  

- Directors of affiliates of the Ministry of Public Security of Vietnam and equivalences, except for cases prescribed in Point c Clause 1 Article 25 of the Law on People's Public Security Force 2018.

- Directors of Departments of Public Security of provinces and centrally affiliated cities classified as first-class provincial administrative units and areas which are important, complicated in terms of security, order with large scale and dense population: up to 11;

- Deputy Chairpersons of the Inspection Commission of the Central Public Security CPV Committee: up to 3;  

- Deputy Directors of Departments or Deputy Commanders of affiliates of the Ministry of Public Security of Vietnam as prescribed in Point d Clause 1 Article 25 of the Law on People’s Public Security Force 2018.

Number: up to 4 for each unit among 17 units, and up to 3 for each of the remaining units;

- Deputy Directors and equivalences of affiliates of the Ministry of Public Security of Vietnam: 1 for each out of 2 units;

- Deputy Directors of the Department of Public Security of Hanoi and Department of Public Security of Ho Chi Minh City: up to 3 for each unit;

- People’s Public Security officers on secondment approved to be Standing Members of the National Defense and Security Committee of the National Assembly of Vietnam or appointed as General Directors or equivalences.
