Vietnam to complete disclosure of list of facilities failing to ensure fire safety before July 30, 2024

On June 24, 2024, the Prime Minister of Vietnam promulgated Directive No. 19/CT-TTg on strengthening fire safety for multi-storey houses, multi-apartment buildings, and individual houses combined with production and business operations.

Vietnam to complete disclosure of list of facilities failing to ensure fire safety before July 30, 2024 

According to the Directive, to proactively prevent fires and explosions and minimize damage caused by fires and explosions, the Prime Minister of Vietnam requests Presidents of People’s Committees of provinces and centrally affiliated cities to: 

- Promulgate documents on guidelines on essential solutions to the improvement of fire safety conditions in conformity with local conditions before July 30, 2024 based on the technical documents on guidelines on essential solutions to the improvement of fire safety conditions disclosed by competent authorities of the Ministry of Construction of Vietnam. 

- Direct and organize the review, inspection, classification, and guidance on solutions to fire safety assurance regarding multi-storey houses, multi-apartment buildings (mini apartment buildings), and individual houses combined with production and business operations (including housing for rent); request heads of facilities and households to declare to have roadmaps for the implementation of solutions to fire safety enhancement promulgated by People’s Committees of provinces and centrally affiliated cities and complete the implementation of such solutions before March 30, 2025. After the mentioned time limit, any organization that fails to comply with the mentioned tasks shall have its operations suspended until such tasks are completed. 

- Direct and review the issuance of business registration certificates regarding multi-storey houses, multi-apartment buildings, and individual houses combined with production and business operations (including housing for rent).  During the issuance of construction and repair permits for the mentioned types of houses, it is mandatory to drastically request heads of facilities and households to implement fire safety assurance solutions and conditions as per regulation. 

- Direct and organize the review and strict implementation of the handling of local facilities failing to ensure fire safety requirements that are put into operation before the effective date of the Law on Fire Prevention and Fighting No. 27/2001/QH10 according to the Resolutions of Provincial People’s Councils implementing Article 63a of the Law on Fire Prevention and Fighting. This task shall be completed within 2024. 

- Direct the review of construction planning and urban planning for residential areas and areas of renovation, urban embellishment, and clearance to adopt measures to limit the risk of fire and explosion; pay special attention to the traffic conditions and water sources for firefighting and rescue. Direct the decisive settlement of the illegal expansion to occupy common paths and obstruct traffic and emergency exits and unsafe installation of electricity and telecommunications lines as per regulation. 

- Direct the disclosure of lists of facilities failing to ensure fire safety on their websites. This task shall be completed before July 30, 2024.
