On August 14, 2023, the Government of Vietnam promulgated Resolution No. 128/NQ-CP on amendments to Resolution No. 32/NQ-CP 2022 on visa waiver for citizens of the Federal Republic of Germany, the French Republic, the Italian Republic, the Kingdom of Spain, the United Kingdom and Northern Ireland, the Russian Federation, Japan, the Republic of Korea, the Kingdom of Denmark, the Kingdom of Sweden, the Kingdom of Norway, the Republic of Finland, and the Republic of Belarus.
According to the Resolution, the content of the visa waiver for citizens of countries prescribed in Article 1 of Resolution No. 32/NQ-CP 2022 is amended as follows:
The visa waiver will apply to citizens of the Federal Republic of Germany, the French Republic, the Italian Republic, the Kingdom of Spain, the United Kingdom and Northern Ireland, the Russian Federation, Japan, the Republic of Korea, the Kingdom of Denmark, the Kingdom of Sweden, the Kingdom of Norway, the Republic of Finland, and the Republic of Belarus who stay in Vietnam for 45 days from the date of entry, regardless of their visa types and purposes of entry with adequate eligibility criteria in accordance with Vietnamese laws.
Resolution No. 128/NQ-CP 2023 comes into force as of August 15, 2023.
According to Article 12 of the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam 2014 and Clause 7 Article 1 of the Law on Amendments to the Law on Entry, Exit, Transit, and Residence of Foreigners 2019, cases eligible for visa waiver in Vietnam are as follows:
- Cases prescribed in international treaties to which the Socialist Republic of Vietnam is a signatory:
- Use of permanent residence cards and temporary residence cards according to the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam 2014.
- Entry to checkpoint economic zones, special administrative - economic units.
- Entry to coastal economic zones decided by the Government if fully satisfying the following conditions: having international airports; having private space; having a defined geographical border separated from inland; being in conformity with socio-economic development policies and not harming national defense and security, social safety, and order of Vietnam.
- Cases subject to Article 13 of the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam 2014.
- Vietnamese people residing overseas who have passports or laissez-passers issued by foreign authorities, foreigners being their spouses or children; foreigners being spouses and children of Vietnamese citizens shall be granted visa-free entry as prescribed by the Government of Vietnam.
