Vietnam to amend regulations on verification of changes to certificates of land use rights during land-related change registration

Circular No. 02/2023/TT-BTNMT has amended Clause 3 Article 17 of Circular No. 23/2014/TT-BTNMT (amended by Circular No. 33/2017/TT-BTNMT) as follows:

- The issuance of certificates of land use rights for cases prescribed in Points a, b, e, g, h, l, m, and r of Clause 1 and Points a, c, d, đ, e, g, h, and i of Clause 2 Article 17 of Circular No. 23/2014/TT-BTNMT shall comply with Article 37 of Decree No. 43/2014/ND-CP (amended by Clause 5 Article 1 of Decree No. 10/2023/ND-CP).

- With regard to cases prescribed in Point n Clause 1 and Point b Clause 2 Article 17 of Circular No. 23/2014/TT-BTNMT, agencies of natural resources and environment shall perform the procedure prescribed in Clause 2 Article 69 of Decree No. 43/2014/ND-CP;

After the performance of the procedure mentioned above, agencies of natural resources and environment shall transfer the dossiers to the agencies prescribed in Article 37 of Decree No. 43/2014/ND-CP (amended by Clause 5 Article 1 of Decree No. 10/2023/ND-CP) for certificate issuance.  

(Previously, according to Clause 3 Article 17 of Circular No. 23/2014/TT-BTNMT (amended by Circular No. 33/2017/TT-BTNMT), regulations on verification of changes to certificates of land use rights during land-related change registration were as follows:

- The issuance of certificates of land use rights for cases prescribed in Points a, b, e, g, h, l, m, and r of Clause 1 and Points a, c, d, đ, e, g, h, and i of Clause 2 Article 17 of Circular No. 23/2014/TT-BTNMT shall comply with Article 37 of Decree No. 43/2014/ND-CP and Clause 23 Article 2 of Decree No. 01/2017/ND-CP.

- With regard to cases prescribed in Point n Clause 1 and Point b Clause 2 Article 17 of Circular No. 23/2014/TT-BTNMT, agencies of natural resources and environment shall perform the procedure prescribed in Clause 2 Article 69 of Decree No. 43/2014/ND-CP and transfer the dossiers to Land Registration Offices or their branches for certificate writing; and

Present them to People’s Committees at the same level for decisions to permit the repurposing of lands and issue certificates.)
