Vietnam to amend regulations on notifications of overtime work exceeding 200 and up to 300 hours per year

On February 1, 2024, the Government of Vietnam promulgated Decree No. 10/2024/ND-CP on hi-tech parks, which contains amendments to regulations on notifications of overtime work exceeding 200 up to 300 hours per year.

Vietnam to amend regulations on notifications of overtime work exceeding 200 and up to 300 hours per year 

Decree No. 10/2024/ND-CP provides for directions for construction of and schemes to develop hi-tech parks; establishment and expansion of hi-tech parks; operations at hi-tech parks; regulations, policies, and state management of hi-tech parks (including hi-tech parks prescribed in Article 31 of the Law on High Technologies and hi-tech application agricultural parks prescribed in Article 32 of the Law on High Technologies). 

Previously, Article 62 of Decree No. 145/2020/ND-CP stipulated as follows: 

(1) When organizing overtime work that exceeds 200 hours and up to 300 hours per year, the employer shall notify the Departments of Labor - War Invalids and Social Affairs of:

- The province where the overtime work takes place;

- The province where the employer is headquartered if it is different from the province mentioned above.

(2) The notification shall be sent within 15 days from the initiation date of the overtime work.

(3) The notification shall be prepared according to Form No. 02/PLIV in Appendix IV enclosed with Decree No. 145/2020/ND-CP.

Decree No. 10/2024/ND-CP has amended regulations on notifications of overtime work exceeding 200 and up to 300 hours per year prescribed in Article 62 of Decree No. 145/2020/ND-CP as follows: 

If the employer is headquartered or organizes the overtime work in a hi-tech park, notify the Management Board of such a hi-tech park of the overtime work according to the time and form prescribed in (2) and (3). 

Decree No. 10/2024/ND-CP of Vietnam comes into force as of March 25, 2024 and replaces Decree No. 99/2003/ND-CP.
