Vietnam to amend procedure for licensing import of cultural products for non-commercial purposes

On November 23, 2023, the Ministry of Culture, Sports and Tourism of Vietnam promulgated Decision No. 3605/QD-BVHTTDL 2023 on disclosure of amended administrative procedures concerning performance arts under the management of the Ministry.

Vietnam to amend procedure for licensing import of cultural products for non-commercial purposes 

From January 15, 2024, the procedure for licensing the import of cultural products that are audio and video recordings of performance arts for non-commercial purposes shall be performed as follows: 

- Any organization or individual that wishes to import cultural products subject to one of the following cases shall submit an application for a license through postal services or in person to the Department of Performance Arts (Ministry of Culture, Sports and Tourism of Vietnam):

+ Cultural products that are audio or video recordings of performance arts, used for exchange, cooperation, aid, and participation in national exhibitions, competitions, or celebrations;

+ Cultural products that are audio and video recordings of performance arts prescribed in Clause 1 Article 6 of Decree No. 32/2012/ND-CP, used for professional operations or studies of Ministries and central authorities after collecting written suggestions of concerned Ministries and central authorities; 

+ Cultural products that are audio and video recordings of performance arts for use or other purposes nationwide or in many different provinces. 

- The Department of Performance Arts receiving the application shall inspect the validity of the application, make a receipt, and schedule a time to return the license.

- Within 2 working days after receiving the valid application, the Department of Performance Arts shall issue a license.  If suggestions from concerned Ministries and central authorities are needed, the time limit for license issuance may be extended by up to 10 working days.

- The organization or individual shall receive the license at the Department of Performance Arts or through postal services. 

- In case of refusing to issue the license, answer and explain in writing. 

Implementation method: applications for licenses to import cultural products shall be submitted to the Department of Performance Arts through postal services or in person.
