Vietnam to add more cases of compulsory medical treatment to be applied as of January 1, 2024

On January 9, 2023, the XV National Assembly of Vietnam approved the Law on Medical Examination and Treatment 2023 at the 2nd irregular meeting.

According to the Law, additional cases of compulsory medical treatment to be applied as of January 1, 2024 are as follows:

- People with infectious diseases of Group A according to laws on infectious disease prevention and control;

- People with depression with suicidal thoughts and behaviors; mentally ill people in an agitated state capable of harming themselves, conducting acts that cause harm to others, or destroying property;

(The Law on Medical Examination and Treatment 2023 has added the case where mentally ill people in an agitated state are "capable of harming themselves or destroying property" compared to the Law on Medical Examination and Treatment 2009.)

- Other cases as prescribed by law.  (New regulation)

The Government of Vietnam shall stipulate measures to perform compulsory medical treatment for cases mentioned above.

The Law on Medical Examination and Treatment 2023 comes into force as of January 1, 2024 and replaces the Law on Medical Examination and Treatment 2009, except for cases prescribed in Clauses 3, 4, 5, 6, 7, 8, 9 Article 120 of the Law on Medical Examination and Treatment 2023.
