Vietnam: Time limit for not establishing and managing enterprises, cooperatives after resigning in the military

On July 08 2021, Ngày 08/7/2021, the Ministry of National Defense of Vietnam issued Circular No. 80/2021/TT-BQP stipulating the time limit for persons holding positions and powers in the military not to establish or hold managerial or executive positions in enterprises or cooperatives in the fields they were previously responsible for management after retirement; stipulating the list and period of periodic change of working positions in agencies and units under the Ministry of National Defense of Vietnam.

According to the Circular No. 80/2021/TT-BQP, within 12 months from the date of resignation from holding positions and powers in units of the Ministry of National Defense of Vietnam, persons holding positions and powers in the Military work in the fields specified in Article 6 of the Circular No. 80/2021/TT-BQP (for example, planning and investment, finance, economics, equipment, supplies, logistics, technology; defense inspector, etc.) shall not establish, hold managerial positions, operate private enterprises, limited liability companies, joint-stock companies, partnerships and cooperatives in the fields they were previously responsible for management.

Based on the subjects under their management, cadres or military agencies shall assume the prime responsibility for, and coordinate with inspection agencies at the same level in, determining and advising competent persons on the application of the provisions of Chapter II of this Circular and stated in the decision to stop holding the position of the person holding the position and authority.

The Circular No. 80/2021/TT-BQP takes effect from August 25, 2021.
