This is a content mentioned in Ordinance No. 03/2022/UBTVQH15 dated December 13, 2022 of the Standing Committee of the National Assembly of Vietnam on procedures for consideration and decision on imposition of administrative penalties at the People’s Courts.
According to Ordinance No. 03/2022/UBTVQH15 of the Standing Committee of the National Assembly of Vietnam, the time limit for complaint about decisions of the Court is 05 working days from the date on which the Court issues the decisions.
- If the complainant is absent from the meeting or the Court fails to organize the meeting and issue a decision which this Ordinance elaborates that he/she is entitled to complain about, the time limit for complaint is 05 working days from the date on which the complainant receives the decision of the Court.
- If the complainants cannot exercise their right to complain within the above time limit due to force majeure events or objective obstacles, the duration of occurrence of such force majeure events or objective obstacles shall not be included in the time limit for complaint.
(According to Vietnam’s current regulations, the time limit for complaints is 03 working days from the date the Court announced the decision; in case they are absent from the meeting, the time limit for lodging a complaint is 3 working days from the date of receiving the Court's decision.)
Ordinance No. 03/2022/UBTVQH15 of the Standing Committee of the National Assembly of Vietnam takes effect from February 01, 2023 and replaces Ordinance No. 09/2014/UBTVQH13 in 2014.
