Vietnam: The Department of Justice is responsible for guiding the damage sufferers to make compensation claims

This is an important content of the Circular No. 07/2020/TT-BTP guiding the functions, tasks and powers of the Department of Justice under the People's Committee of the province, the Division of Justice under the People's Committee of the district.

As a specialized agency of the Provincial People's Committee, the Department of Justice has the tasks and responsibilities specified in Article 2 of the Circular No. 07/2020/TT-BTP of the Ministry of Justice of Vietnam. In particular, regarding state compensation, the duties and responsibilities of the Department of Justice according to Clause 12 Article 2 of the Circular No. 07/2020/TT-BTP are as follows:

- Guiding and training skills and professionalism in the work of state compensation in accordance with the law;

- Guiding the damage sufferers to carry out the procedures for claiming compensation within the locality; propose the People's Committee of the province to propose competent agencies to handle violations in the settlement of compensation, fulfillment of responsibility for reimbursement in administrative management, proceedings and judgment enforcement activities in the locality;

- Proposing and submitting to the People's Committee of the province to determine the compensation settlement agency in accordance with the law; participate in damage verification when requested by the compensation agency; participate in the negotiation of compensation in the locality under the management competence of the People's Committee of the province;

- Monitor, urge and inspect the work of state compensation;
