On December 27, 2023, the Minister of Industry and Trade of Vietnam issued Circular 39/2023/TT-BCT on tariff quotas for importing raw tobacco in 2024.

The amount of tariff quota for importing raw tobacco (HS code 2401) in 2024 is 71,835 tons.

Tariff quotas for importing raw tobacco are allocated according to the method specified in Decree 69/2018/ND-CP dated May 15, 2018 of the Government detailing a number of articles of the Law on Foreign Trade Management; Circular 12/2018/TT-BCT dated June 15, 2018 of the Ministry of Industry and Trade detailing a number of articles of the Law on Foreign Trade Management; and Decree 69/2018/ND-CP dated May 15, 2018 of the Government detailing a number of articles of the Law on Foreign Trade Management.

Tariff quotas for importing raw cigarettes are assigned to traders who have a cigarette production license issued by the Ministry of Industry and Trade and have a need to use imported raw cigarettes for cigarette production.

Subjects considered for import licenses according to tariff quotas

According to Article 14 of Circular 12/2018/TT-BCT, subjects considered for import licenses under tariff quotas include:

(1) For raw tobacco products: Traders have a cigarette manufacturing license issued by the Ministry of Industry and Trade and need to use imported raw tobacco for cigarette production.

(2) For salt products: traders wishing to use salt for production are certified by a specialized management agency.

(3) For poultry eggs: Traders wishing to import poultry eggs.

(4) For refined sugar and raw sugar: follow the annual guidance of the Ministry of Industry and Trade based on consultation with the Ministry of Agriculture and Rural Development and the Ministry of Finance.

(5) The Ministry of Industry and Trade determines the time of tariff quota allocation for the goods specified in Clause (1).

For the items specified in clause (2), clause (3), clause (4), the Ministry of Industry and Trade discussed them with the Ministry of Agriculture and Rural Development and the Ministry of Finance to determine the time of tariff quota allocation.

Circular 39/2023/TT-BCT takes effect from February 12, 2024, to December 31, 2024.
