Vietnam: Supplements documents to the application for establishment of social and charity funds

On November 25, 2019, the Government of Vietnam issued Decree No. 93/2019/ND-CP prescribing organization and operation of social and charity funds (hereinafter referred to as “funds").

Decree No. 93/2019/ND-CP of Vietnam’s Government supplements documents to the application for establishment of funds. Specifically, in addition to the currently required documents such as an application form for fund establishment; the draft charter of the fund; CVs and criminal records of members of the fund founding board and other documents; documentary evidences of assets contributed to the fund, an application for establishment of funds requires the following documents:

- The written commitment on asset contribution made by the fund’s founding members;

- Documents indicating the appointment of title holders of the fund founding board;

- Documents certifying the planned head office of the fund.

01 set of application for fund establishment shall be made and sent to the competent authority, which is the Ministry of Home Affairs or the provincial-level People’s Committee, depending on the scale of the fund.

More details can be found in Decree No. 93/2019/ND-CP of Vietnam’s Government, which takes effect from January 15, 2020.
