On October 9, 2024, Vietnam Social Security issued Official Dispatch 3566/BHXH-TCCB providing guidance on the implementation of Decree 111/2022/ND-CP.

Heads of units and Directors of provincial Social Insurance agencies in Vietnam are authorized to sign labor contracts for employees according to the regulations of the Labor Code 2019. To be specific:

- The labor contract template follows the form issued with Circular 05/2023/TT-BNV dated May 3, 2023, by the Minister of Home Affairs of Vietnam guiding the service and labor contract templates for certain types of work in administrative agencies and public service providers.

- For new labor contracts related to support and service work, the probationary period shall not exceed 1 month. After the probation period, units will evaluate the trial results, and if the work requirements are met, a fixed-term contract will be signed as follows: the first contract is for 12 months, and if evaluated positively, a second contract for 36 months will be signed. Upon completion of these two fixed-term contracts, an indefinite-term labor contract will be executed.

- For new labor contracts involving professional and technical work, the probationary period shall not exceed 2 months. After the probation period, units will evaluate the trial results, and if the work requirements are met, a fixed-term contract will be signed as follows: the first contract is for 12 months, and if evaluated positively, a second contract for 36 months will be signed. Upon completion of these two fixed-term contracts, an indefinite-term labor contract will be executed.

- In cases where the unit or individual does not require or the unit cannot allocate funding, the unit's Head or the Director of provincial Social Insurance agencies, who is authorized, shall terminate the labor contract according to the Labor Code 2019.
