Vietnam: SMEs in the legal sector are supported with legal consultancy fees

On July 25, 2019, the Ministry of Justice of Vietnam issued Decision No. 1696/QD-BTP in 2019 on announcement of administrative procedures in the field of legal aid for small and medium-sized enterprises (SMEs) within the scope of management functions of the Ministry of Justice.

According to Decision No. 1696/QD-BTP of the Ministry of Justice of Vietnam, SMEs have access to a network of legal advisors within the management scope of the ministry or equivalent agencies through a list of legal advisors published on the ministry's or equivalent agency's information portal.

After reaching an agreement on legal consultancy services with a legal advisor, the enterprise shall submit an application to the ministry or equivalent agency to request support for the legal consultancy fees related to the case or issues at hand.

The application includes:

- A declaration identifying the micro-enterprise, small enterprise, or medium-sized enterprise according to the form prescribed in Decree No. 39/2018/ND-CP of Vietnam’s Government and related documents.

- A copy of the Enterprise Registration Certificate.

- The legal consultancy service contract between the legal advisor and the enterprise, specifying the consultancy content and fees.

Decision No. 1696/QD-BTP of the Ministry of Justice of Vietnam takes effect from August 16, 2019.
