Vietnam’s new regulations on direct contracting for supply of drugs for public health facilities

Recently, the Ministry of Health of Vietnam issued Circular No. 15/2019/TT-BYT providing guidance on bidding for supply of drugs for public health facilities.

According to Article 23 of Circular No. 15/2019/TT-BYT of the Ministry of Health of Vietnam, usual direct contracting and simplified direct contracting shall apply as follows:

- Usual direct contracting applies to contract packages worth VND1 billion at most specified in Point e, Clause 1, Article 22 of Law on Bidding of Vietnam; the usual direct contracting procedures are specified in Article 55 of Decree No. 63/2014/ND-CP of Vietnam’s Government.

- Simplified direct contracting applies to contract packages specified in Point a Clause 1 Article 22 of Law on Bidding and Article 79 of Decree No. 63/2014/ND-CP; the simplified direct contracting procedures are specified in Article 56 of Decree No. 63/2014/ND-CP after the contractor selection plan is approved.

In addition to direct contracting, Circular No. 15/2019/TT-BYT also specifies other contractor selection methods, such as competitive bidding, selective bidding, competitive offering, direct procurement and self-supply.

More details can be found in Circular No. 15/2019/TT-BYT of the Ministry of Health of Vietnam, which takes effect from October 01, 2019.
