On October 29, 2021, Vietnam's Ministry of Natural Resources and Environment promulgated Circular 18/2021/TT-BTNMT< /a> stipulates the rate of collection of fees for the use of marine areas under the assigned competence of the Prime Minister and the Ministry of Natural Resources and Environment.
According to the Circular, the fee for using the sea area within 6 nautical miles and inter-regional waters is regulated as follows:
- The fee for using the sea area for dumping: 20,000 VND/m3.
- The fee level is 7,500,000 VND/ha/year for using the sea area to:
+ To build seaports, floating ports, offshore oil and gas ports and other ports and wharves; as the water area in front of the wharf, the turning area for ships, the mooring area, the transshipment area, the specialized navigational channel, other ancillary works...
+ Construction of underground pipeline system, installation of telecommunications and electric cables.
+ Aquaculture, construction of fishing ports.
+ Harnessing wind, wave, tidal, ocean currents and other marine use activities.
For activities for which the above-mentioned sea area usage fee is not regulated, the Ministry of Natural Resources and Environment of Vietnam will decide on a case-by-case basis but not less than 3,000,000 VND/ha/year and not higher than 7,500,000 VND/ha/year.
