Vietnam’s Law on Identification 2023 to replace Law on Citizen Identification 2014 

The new Law's name has been changed from Law on Citizen Identification to Law on Identification, stipulating the National Database on Population, Database on Identification Data; identification cards, electronic identification cards; certificates of identification; rights, obligations, and responsibilities of relevant authorities, organizations, and individuals.

Definitions concerning identification: 

- Identification means the basic information on the personal identity, background, and biometrics of a person.

- An identification card is the identification document containing the identification and other information integrated into the card of a Vietnamese citizen, issued by an identification authority under the Law on Identification 2023. 

- The electronic identity of a Vietnamese citizen is one of the following information of citizens in the National Database on Identification, allowing the online identification of such a person through the system of electronic identification and authentication for the generation of an electronic identification:

+ Personal identification number; 

+ Surname, middle name, and birth name;

+ Date of birth;

+ Sex; 

+ Face photos; 

+ Fingerprints.

Transitional provisions of the Law on Identification 2023 

(1) A citizen identification card issued before July 1, 2024 shall be valid until the expiry date prescribed in the card, except for the case prescribed in (3). Citizens may receive identification cards as a replacement for citizen identification cards if they wish for the replacement.

(2) A citizen identification card with an expiry date after December 31, 2024 shall be valid until December 31, 2024. Issued documents with legal value using information from citizen ID cards or citizen identification cards shall retain their validity; state authorities shall not request citizens to change or adjust information on citizen ID cards or citizen identification cards in issued documents. 

(3) A citizen identification card or citizen ID card with an expiry date within the range of January 15, 2024 to before June 30, 2024 shall be valid until the end of June 30, 2024.

(4) Regulations on the use of citizen identification cards and citizen ID cards prescribed in legislative documents promulgated before July 1, 2024 shall be applied similarly to regulations on identification cards prescribed in the Law on Identification 2023 until they are amended, supplemented, or replaced.
