Vietnam’s Decree guiding Law on Medical Examination and Treatment 2023 and amending Decree No. 98/2021

Decree No. 96/2023/ND-CP detailing several Articles of the Law on Medical and Examination on: 

- Issuance of practicing certificates of medical examination and treatment;

- Issuance of medical examination and treatment licenses;  

- Application of new techniques and methods and clinical experiments in medical examination and treatment; 

- Medical equipment management at medical examination and treatment facilities; 

- Mobilization of medical examination and treatment facilities to participate in medical examination and treatment in case of natural disasters, tragedies, group A infectious disease epidemics, and emergencies;  

- Conditions for ensuring medical examination and treatment; 

- Guidelines on implementation roadmaps; transitional provisions concerning practicing certificates and operational licenses. 

Decree No. 96/2023/ND-CP does not apply to operations concerning practitioners and medical examination and treatment facilities of the people’s armed forces, including: 

- Practice, guidelines on medical examination and treatment practice, issuance, re-issuance, renewal, adjustment, suspension, and revocation of practicing certificates; 

- Cases, conditions, applications, procedures for issuance, re-issuance, adjustment, suspension, and revocation of operational licenses of medical examination and treatment facilities and forms of operational licenses of medical examination and treatment facilities; 

- Quality assessment and certification for medical examination and treatment facilities; 

- Technical expertise grading for medical examination and treatment facilities. 

Implementation of autonomy regulations of medical examination and treatment facilities that are public service providers shall comply with autonomy laws. 

Amendments to Decree No. 98/2021 on medical equipment management

Decree No. 96/2023/ND-CP has amended 14 contents of Decree No. 98/2021/ND-CP on medical equipment management (from Clause 8 to Clause 21 Article 147 of Decree No. 96/2023/ND-CP).
