On April 16, 2024, the Government of Vietnam promulgated Decree 39/2024/ND-CP regulating the management, protection, and promotion of the value of intangible cultural heritage in the UNESCO List and the National List of cultural heritage practices.
The intangible cultural heritage practice in Vietnam means expressing the cultural manifestations of the community, groups, and individuals aimed at preserving vitality, ensuring continuity, content, practical procedures, constituent elements, principles, natural essence, and value of the type of intangible cultural heritage.
Practitioners of intangible cultural heritage are members of the community that hold the intangible cultural heritage, actively recreating, transmitting, conveying, creating, and shaping culture within the community for the benefit of the community, by performing and maintaining social practices based on specialized knowledge and skills.
The rules of intangible cultural heritage practice in Vietnam include:
- The community must ensure the maintenance of continuity in the intangible cultural heritage practice in line with the value, essence, and function of the heritage; reducing the risk of degradation and loss;
- Ensure the preservation of the heritage's value in its forms of expression, knowledge, skills, techniques, and related practice spaces; not introducing inappropriate elements into the heritage;
- Ensure the comprehensive covering of practices, content, activities, and constituent elements of the heritage with the participation of the community in the practice of heritage;
- Do not disseminate or practice the heritage incorrectly;
- Do not exploit the practice of heritage and the heritage title for profit or engage in illegal activities;
- Ensure the respect and protection of religious, belief, customary values, the sanctity of rituals, and the practice spaces of the intangible cultural heritage.
