Vietnam: Reducing fine for the act of ordering invoice printing without signing a written contract

This is the content specified in Decree No. 49/2016/NĐ-CP of Vietnam’s Government on amendments and supplements to certain Articles of Decree No. 109/2013/NĐ-CP on penalties for administrative violations against regulations on management of prices, fees, charges and invoices.

According to previous regulations, a fine of from VND 2,000,000 to below VND 4,000,000 shall be imposed for ordering invoice printing without signing a written contract. However, according to new regulation of Decree No. 49/2016/NĐ-CP of Vietnam’s Government, the above-mentioned violation shall only be fined from VND 500,000 to VND 1,500,000. Thus, this fine has been decreased significantly compared to previous regulation.

Although the fine for the above violation has been reduced, Decree No. 49/2016/NĐ-CP supplements the case where the entity/enterprise orders invoice printing although the tax agency has informed in writing that the entity/enterprise is unqualified to make order of invoice printing. 

Decree 49/2016 adds the case of fines for ordering invoice printing when the tax authority has issued a written notice that the organization or enterprise does not meet the conditions for ordering invoice printing. If violating, the entity/enterprise will be subject to the following sanctions:

- A fine of from VND 2,000,000 to VND 4,000,000;

- Forced cancellation of invoice.

Regulations of Decree No. 49/2016/NĐ-CP of Vietnam’s Government will officially apply from August 01, 2016.
