Vietnam: Provisional guidelines for regulations on occupational accidents and occupational diseases

Recently, Vietnam Social Security issued Official Dispatch No. 3647/BHXH-CSXH regarding the provisional guidelines for regulations on occupational accidents and occupational diseases in accordance with the Law on occupational safety and hygiene.

According to Official Dispatch No. 3647/BHXH-CSXH of Vietnam Social Security, in respect of documents and procedures for payout of occupational accident insurance, occupational disease insurance claimed by victims thereof who have undergone complete medical treatment and have been discharged from the hospital from July 01, 2016:

* With regard to claims on occupational accident insurance, the documents prescribed in Clause 3, Clause 6 Article 14 of Decision No. 636/QD-BHXH dated April 22, 2016 shall be eliminated, including:

- Investigation record of occupational accident;

- In case of traffic accident which is determined as occupational accident:

+ Record of scene examination and traffic accident scene diagram;

+ Record of traffic accident of police body or army criminal investigation body.

* With regard to claims on occupational disease insurance, the documents consisting of the report of measurement of workplace hazards, or the measurement results of workplace conditions, or copies of excerpts therefrom as prescribed in Clause 3 Article 15 of Decision No. 636/QD-BHXH shall be eliminated;

* With regard to claims on occupational accident insurance or occupational disease insurance (Form No. 5-HSB issued together with Decision No. 636/QD-BHXH), certain contents shall be added.

Official Dispatch No. 3647/BHXH-CSXH was issued on September 21, 2016 by Vietnam Social Security.
