Vietnam: Pardon petition dossier in 2021

According to this Guideline, the pardon petition dossier includes documents prescribed in Article 5 of the Decree 52/2019/ND-CP. Moreover, some particular circumstances shall be required these following documents:

- An inmate or a person currently suspended from serving a prison sentence who has a previous conviction but has had his/her criminal record cleared must have one of the documents proving that his/her criminal record has been expunged: Certificate or decision on criminal record remission of the Court; the sentence states that there is a criminal record but the criminal record has been expunged; a criminal record certificate confirming no criminal record issued by the National Center for Criminal Records or the Department of Justice.

- An inmate or a person who is being suspended from serving a prison sentence in the cases specified at Point e, Clause 3, Article 3 of the Decision No. 1161/2021/QĐ-CTN, must have an application from his family or from the person being suspended to present his/her special  family difficult circumstances and the inmate or the person on temporary suspension is the sole worker. The application must be certified by the commune-level People's Committee of the place where the family of the inmate or the family of the person being temporarily suspended resides.

- Persons sentenced to prison and awarded the titles of People's Teacher, People's Doctor or People's Artist must have a copy of the award decision.
