Vietnam: New guidance on age of appointment and introduction of candidate for officials

Recently, Vietnam Central Organizing Committee promulgated Guidance 06-HD/BTCTW on appointment age , introduce candidates for officials.

According to this Guidance, it is agreed to take the actual retirement age of cadres under the provisions of the Labor Code 2019 and Decree 135/2020/ND-CP of Vietnam as a basis for determining the age conditions for appointment and introduction of candidates for officials. Time for calculating and calculating the age of appointment and nomination of candidates as follows:

- Time of calculation: It is the time when the agency advising on organization and personnel has the authority (Central Organization Board for cases under the Politburo, the Secretariat; the Department of Personnel Organization, etc. for cases not belonging to the Politburo, which are managed by the Secretariat) receive the report and personnel files as prescribed.

- Calculation: Take the actual retirement age of the cadre minus the cadre's age at the time of being proposed for the appointment, introducing candidates for the first time to leadership or managerial position, if there are 5 years or more left, eligible for appointment and nomination of candidates (for positions with a term of appointment and nomination of candidates for 5 years).

The appointment age for officials in the armed forces shall comply with the Law on Officers of the Vietnam People's Army and the Law on People's Public Security Force of Vietnam

Guidance 06-HD/BTCTW of Vietnam was promulgated on July 26, 2021.
