Vietnam: Land rental exemption for construction investment projects in economic zones

This is one of the featured contents of Decree No. 35/2017/ND-CP of Vietnam’s Government prescribing the collection of land use levy, land rental and water surface rental in economic zones and hi-tech zones, which comes into force from June 20, 2017.

According to Decree No. 35/2017/ND-CP of Vietnam’s Government, land rental and water surface rental shall be exempted for the entire lease period for certain construction investment projects in economic zones, such as:

- Investment projects on the list of sectors eligible for special investment incentives;

- Investment projects to build houses for workers;

- Land for construction of non-business works of public non-business units;

- Land for construction of maintenance and repair stations and parking lots (also including ticket sale offices, administration offices and public service facilities) to serve public transportation;

- Land for construction of water supply facilities in economic zones, including water exploitation and treatment facilities, pipelines and facilities on the water supply network and works in support of the management and operation of the water supply system.

Decree No. 35/2017/ND-CP annuls and removes:

- Clause 4 Article 19 and Clause 2 Article 20 of Decree No. 46/2014/ND-CP of Vietnam’s Government;

- The phrase “economic zones and hi-tech zones” in Clause 6 Article 3 of Decree No. 135/2016/ND-CP of Vietnam’s Government.
