The General Department of Customs issued Official Dispatch 6464/TCHQ-GSQL regarding the implementation of the EVFTA Agreement.
Responding to Official Dispatch 2579/HQHCM-GSQL dated September 7, 2020, of the Ho Chi Minh City Customs Department, the General Department of Customs requests the Ho Chi Minh City Customs Department to rely on the following Circulars for inspection and handling of self-certification of origins in cases where the seller is located in the territory of a non-EVFTA party:
- Article 24 of Circular 11/2020/TT-BCT stipulates the declaration form and information on the self-certification of origin for goods from the European Union;
- Article 3 of Circular 11/2020/TT-BCT defines the exporter, specifically: “the exporter is an individual or organization with headquarters located in the exporting Member State, exporting goods to another Member State, capable of proving the origin of goods...”;
- The inspection to determine the validity of the certification of origin documents and the origin of imported goods is based on the provisions of Circular 38/2018/TT-BTC (as amended and supplemented by Circular 62/2019/TT-BTC) and related documents.
