Vietnam: Guidelines for handling the request for exclusion from trade remedies

Recently, the Trade Remedies Authority of Vietnam affiliated to the Ministry of Industry and Trade issued the Notice No. 04/TB-PVTM providing guidelines for submitting requests for exclusion from trade remedies.

When handling the request for exclusion from trade remedies, the investigating agency will consider and evaluate, including but not limited to, the following factors:

- The product requesting exemption.

- Legal status and production/business capacity of the organization/individual requesting exemption.

- Production and business plans, material consumption norms, and exemption conditions.

- Other provisions specified in Article 10, Article 12, and Article 13 of Circular No. 37/2019/TT-BCT of the Ministry of Industry and Trade of Vietnam.

Notably, if necessary, the investigating agency may arrange meetings with relevant parties, including conducting verification at the production and business premises of the organizations and individuals involved, to clarify the aforementioned contents.
