On September 18, 2020, the Ministry of Labor, War Invalids and Social Affairs of Vietnam issued Official Dispatch 3595/LDTBXH-BHXH providing guidelines for determination of the working period of employees who no longer have original documentation showing their working period before January 1, 1995.
Where the employee in Vietnam no longer has original documentation showing their working period before January 1, 1995, the Vietnam Social Security shall consider and decide on the inclusion or exclusion of the working period before January 1, 1995 in the period of paying social insurance premiums for the employee. This decision shall be made based on the employee's application, a confirmation letter from the employee's managing agency, and other documents related to the working period to be considered for including it in the period covered by social insurance benefits in Vietnam. These documents may include Communist Party member profile, trade union member profile, employment book, labor list, tracking book, payroll list, actual salary book, certificates of merit, diplomas of merit, commemorative badges, diplomas, certificates, and documents on settlement of the employee's policies during the privatization of state-owned enterprises.
The determination of the working period before January 1, 1995 to enjoy social insurance benefits for employees without original documentation shall be conducted from the date Vietnam Social Security issues an approval document.
