Vietnam: Fees and charges for the protection of plant variety rights from August 6, 2021
On June 22, 2021, the Ministry of Agriculture and Rural Development issued Circular 03/2021/TT-BNNPTNT modifing and supplementing Circular 16/2013/TT-BNNPTNT on protection of plant variety rights in Vietnam.

From August 6, 2021, the fees and charges for the protection of plant variety rights in Vietnam are regulated as follows:
- Fees and charges for the protection of plant variety rights in Vietnam shall follow Circular 207/2016/TT-BTC, for example:
+ Fees for granting protection titles and certificates of registration of industrial property rights transfer contracts in Vietnam: 350,000 VND/degree;
+ Fee for filing an application for protection of intellectual property rights in Vietnam: 100,000 VND/degree;
+ Seed garden recognition fee: 2,400,000 VND/variety garden;...
- The time limit for paying the validity maintenance fee is within three (03) months after the date of grant of the protection title for the first effective year and the first month of the next effective year for the following years.
In case Circular 207/2016/TT-BTC is amended, supplemented or replaced by another document, the newly issued document shall apply.
Circular 03/2021/TT-BNNPTNT takes effect from August 6, 2021.
