Vietnam: Failure to make health declaration may result in criminal prosecution

This is a notable content of the Official Dispatch No. 45/TANDTC-PC regarding trial for criminal offenses against regulations on prevention and control of Covid-19 pandemic issued on March 30, 2020 by the Council of Justices of Supreme People's Court of Vietnam.

According to the Official Dispatch No. 45/TANDTC-PC of the Council of Justices of Supreme People's Court of Vietnam, when a person who has been informed that he/she is a confirmed case of Covid-19 infection, is suspected of Covid-19 infection or returns from an affected area and is requested to quarantine commits one of the following actions and subsequently transmits Covid-19 to another person, he/she will face a charge of “spreading dangerous infectious diseases in human”:

- Breaking out of the quarantine area;

- Failure to comply with quarantine regulations;

- Refusing or avoiding quarantine or enforcement of quarantine;

- Failure to make or truthfully make health declaration.

Concurrently, when a person who is not a confirmed case of Covid-19 infection and living in an area that has to be put into quarantine or lockdown under an official decision breaks out of the area being put in quarantine or lockdown and subsequently causes a loss of 100.000.000 in epidemic control expense or above, he/she will face a charge of “violation against regulations of law on safety in crowded areas”.
